Plain English Summary

2/10 complexity

These Regulations take effect immediately, revoke the 2003 Fences Regulations, and specify two classes of land exempt from the Fences Act 1975 under section 20(3). The exemptions are: land held by the Commissioner of Highways or a council to control access to a road (or proposed road); and Crown, Crown agency/instrumentality or council land used solely or principally for drainage. Mechanically, the instrument narrows the Act’s coverage by removing these lands from the Act’s fence rules.
