Fences Act 1975

Definitions and characterisation of participants and work are central to the Act. “Adjoining owners” are owners of contiguous land (s 4(1): “adjoining owners”), and contiguity includes a common boundary or separation by a right of way not exceeding one metre (s 4(2)). “Owner” is defined expansively to capture freehold proprietors, life tenants, persons under sale agreements, lessees and long-term licensees and any occupier authorised by the owner to carry out fencing work (s 4(1): “owner”). The “proponent” is the owner proposing the work; “adjoining owner” is the owner of the contiguous land (s 4(1)).

“Fencing work” is defined to include erection of new dividing fences and replacement, repair or maintenance of existing dividing fences; the definition expressly encompasses trimming or maintaining vegetation that serves as a fence and works to watercourses, ditches or other geographical features that serve as a fence (s 4(1): “fencing work”; “replacement, repair or maintenance work”). “Dividing fence” is a fence dividing contiguous land of adjoining owners (s 4(1)). “Cost” is defined broadly to include survey costs reasonably required, work reasonably required to facilitate fencing work, and a reasonable allowance for labour where an adjoining owner performs or proposes to perform the work personally (s 4(1): “cost in relation to fencing work”).

Notice and counter-notice mechanics are prescriptive. A proponent may serve a notice of intention to perform fencing work using Form No 1 (erection) or Form No 2 (repair/replacement/maintenance) in the Schedule, and specified particulars must be included (s 5(1)-(4)). An adjoining owner can object within 30 days by serving a cross-notice (Form No 3) and may set out counter-proposals; the proponent then has 30 days to object to counter-proposals (s 6). Failure to object within time amounts to deemed agreement (s 7).

Timing and entitlement to proceed are fixed: the proponent may proceed 30 days after service if no cross-notice is served, or after agreement or court adjudication if a cross-notice is served (s 8(1)). Work done before entitlement is generally not recoverable, with statutory exceptions (s 8(2)). The Act provides a default lapse period if neither party proceeds: a prescribed period agreed by parties or court; otherwise four months (s 8(5)-(6)).

Adjudication principles: the court can determine virtually all aspects of fencing disputes (s 12). Contributions are ordinarily apportioned by the benefit each adjoining owner derives (s 12(6)), with a presumption of equal benefit absent proof. A special rule applies where the fencing work establishes an “adequate fence” or better: contribution in the absence of agreement is one-half of the minimum cost of erecting an adequate fence, or converting to one (s 12(7)). “Adequate fence” is context-sensitive: for land used for primary production of at least 0.8 hectare that is being fenced against residential or other uses, the adequate fence is the cheaper of the fence adequate for primary production or for the residential/other purpose (s 12(8)(aa)). Otherwise, adequate fence is one conforming with general standards of good fencing in the locality and adequate for the purposes of the owner against whom contribution is sought (s 12(8)(a)-(b)).

Additional concepts: s 16 allows urgent repair without notice and a capped recoverable amount, s 17 prevents occupation within a fence erected other than on the boundary from giving title by adverse possession, and s 21 extinguishes any prescriptive obligation to fence or maintain a fence. Entry powers for carrying out authorised fencing work (agreement, court order or otherwise authorised by the Act) are provided but subject to conditions including at least two days written notice except in emergencies (s 18). Crown and council application is subject to exclusions (s 20).

The Act allocates costs, rights and procedural burdens among several categories of persons. Primary affected parties are:

• Proponents: any owner proposing fencing work as defined in s 4(1) and who initiates the statutory notice process (s 5). Proponents carry the initial administrative burden of serving notices in Form No 1 or No 2, including particularised information (length/position, nature of fence, cost estimate, contractor details and amount sought from the adjoining owner) (s 5(2)-(4)). Proponents also bear timing risk: they may not recover contributions for work performed before becoming entitled to proceed (s 8(2)), except where other provisions apply (s 9, s 10, s 16).

• Adjoining owners: owners of contiguous land who receive notices and who must either consent, serve a cross-notice within 30 days, or risk deemed agreement (s 6-7). They face potential liability for contribution to the cost of fencing work, subject to apportionment and judicial determination (s 12). They are also exposed to short response windows and the consequences of failing to serve a cross-notice (deemed agreement under s 7).

• Owners whose land abuts public roads: where a fence divides private land from a public road, other owners abutting the same road who derive a use or benefit may be ordered to contribute by the court (s 11). Such third-party exposure is discretionary, based on benefit.

• Landlords and tenants: landlords may recover contributions as a debt from tenants under a graduated scale linked to the remaining term of the tenancy (s 14(1)-(2)). Tenants have specific defences (s 14(4)). Where a tenant exercises an option to purchase on fixed terms, the former landlord may augment the purchase price with sums paid for fencing during the tenancy (s 14(3)).

• Life tenants and remaindermen/reversioners: the Act provides a right for a life tenant who incurs liability to recover a contribution from the remainderman/reversioner, calculated by the value ratio of the remainderman’s interest to a fee simple (s 15).

• Persons performing urgent repairs: either adjoining owner may perform urgent repairs and recover half the cost or the amount the other would be liable for if replaced, whichever is lesser (s 16(1)); however an owner cannot recover for work repairing damage caused by his own wrongful act (s 16(3)).

• Owners and occupiers of Crown lands and council land: the Act applies to Crown, instrumentality or council land except where the land is a single parcel over one hectare, comprises a public road/public road reserve, or is exempted by regulation (s 20).

• Persons with rights or liabilities under earlier legislation: s 3 preserves proceedings commenced under the repealed 1924 Act and continues certain earlier rights (s 3(2)-(3)).

Court and enforcement actors are also affected. The Magistrates Court is designated as the forum for determinations (s 4(1): “court”; note legislative history substituting Magistrates Court), and it is empowered to determine line, nature, cost, compensation and apportionment (s 12), to order access, removal of fences, and to make costs orders. Parties who may be “interested persons” include those who will be liable for or entitled to contributions; such persons are entitled to appear in proceedings under s 12(9).

Finally, surveyors, contractors and labourers are indirectly affected because the Act explicitly recognises survey costs and reasonable labour allowance for owners doing the work personally in the calculation of “cost” (s 4(1)). The Schedule forms require naming contractors (s 5(2)(f), s 5(4)(d)), and the court can determine who performs which part of the work (s 12(2)(c)).

The Act creates a set of procedural duties and substantive rights affecting notice, conduct of fencing work, cost recovery, access, and dispute resolution.

Notice and response duties

• Duty to serve a compliant notice: A proponent who proposes fencing work may serve a notice in the prescribed form stating required particulars such as length, position, nature and cost estimates and the amount sought from the adjoining owner (s 5(1)-(4)). For repair/replacement work, particulars are specified in Form No 2 (s 5(3)-(4)). Notices must be signed and served personally or by registered post (s 19(1)-(2)).
• Right to object by cross-notice: An adjoining owner may object within 30 days by serving a cross-notice in Form No 3, specifying which proposals are objected to and optionally making counter-proposals (s 6(1)-(2)). A proponent then has 30 days to object to counter-proposals (s 6(3)).
• Deemed agreement: Failure to object within the statutory time is deemed agreement to the proposal or counter‑proposal (s 7).

Entitlement to proceed and timing obligations

• Proponent’s entitlement: The proponent may proceed with the fencing work after 30 days if no cross-notice is served, or after agreement or court adjudication where a cross-notice is served (s 8(1)). If the proponent does not proceed within 28 days after becoming entitled, the adjoining owner may proceed (s 8(3)). If work is discontinued for more than 28 days, the other party may complete it (s 8(4)).
• Lapse for inaction: If neither party proceeds for the prescribed period (agreed, court-fixed or default four months), the agreement as to the remaining part lapses (s 8(5)-(6)). The court may extend limitations of time on application (s 12(3)).

Cost recovery and apportionment

• Recoverable costs: The Act defines recoverable “cost” to include reasonably required survey costs, facilitative work, and reasonable labour allowance where the owner does the work personally (s 4(1): “cost in relation to fencing work”). Except as otherwise provided, no contribution is recoverable for work performed before the proponent becomes entitled to proceed (s 8(2)).
• Contribution apportionment: The court determines relative proportions based on the benefit derived by each adjoining owner, with an evidential presumption of equal benefit absent proof to the contrary (s 12(6)). Where the fencing work results in an adequate or better fence, and absent agreement, contribution liability is one-half of the minimum cost of erecting an adequate fence or converting the existing fence (s 12(7)). The Act defines “adequate fence” by context (s 12(8)).

Access and entry rights

• Entry for authorised fencing work: Any person may enter at reasonable times with vehicles and equipment to carry out authorised fencing work (agreement, court order, or otherwise authorised) and do what is reasonably required, subject to at least two days written notice except in an emergency (s 18(1)-(3)). The exercise of these powers must avoid injury to land or property so far as reasonably practicable (s 18(3)).

Emergency repairs and damage liabilities

• Urgent repair without notice: Either adjoining owner may, without notice, carry out urgent repair or restoration work to a dividing fence and recover one-half of the cost or the contribution the other would be liable for on replacement, whichever is less (s 16(1)). A person who causes damage by wrongful act is liable to the cost of repair as a debt (s 16(2)), and an owner cannot recover contribution under the Act to the extent the damage resulted from his own wrongful act (s 16(3)).

Special rights and duties for landlords, tenants and life tenants

• Landlord recovery: Landlords may recover contributions as a debt according to a graduated scale tied to the remaining tenancy term, with no tenant liability if under three years remain and full recovery if twelve or more years remain, subject to agreement and defences (s 14(1)-(4)).
• Life tenant recovery: Life tenants who incur liability to perform fencing work are entitled to recover a contribution from the remainderman/reversioner proportionate to the remainderman’s value relative to fee simple (s 15).

Proceedings and court powers

• Broad court powers: The Magistrates Court may determine fencing disputes in a manner it considers just and make orders about fence line, type, performance, costs, compensation, access, removal of fences, reopening agreements, and costs (s 12(1)-(2)). It can also re-open or vary agreements deemed made under the Act (s 12(2)(d)).
• Appeal cost variation: On appeal the court may vary determinations of cost to account for cost changes occurring after the original determination (s 12A).

Other important rights and limits

• Extinguishment of prescriptive rights: Any prescriptive obligation to fence or maintain a fence is extinguished (s 21), which alters historical common law reliance on prescription.
• Protection against adverse possession: Erection of a fence other than upon the boundary pursuant to agreement or court order does not give rise to a claim of adverse possession under the Real Property Act (s 17).
• Crown and council exceptions: The Act generally applies to Crown and council land, but it omits application in specified circumstances (single parcel over one hectare, public roads/road reserves, or land exempted by regulation) (s 20).

The Fences Act 1975 primarily structures civil remedies and does not create criminal penalties within the textual provisions supplied. Enforcement is civil and court-directed. The Act’s enforcement and remedial architecture operates through the Magistrates Court and through debt and contribution recovery mechanisms.

Court orders and enforcement mechanisms

• Court-ordered payment: If an owner claims an amount from an adjoining owner in respect of fencing work, the court may make an order for payment (s 12(4)-(5)). Such orders are enforceable as civil judgments of the court.
• Power to order entry and access: The court may make any order necessary or expedient in relation to entry upon or access to land for the purposes of performing fencing work (s 12(2)(g)). That includes directions to facilitate completion where access was disputed.
• Removal and correction orders: The court may order removal of a fence or portion of a fence not erected upon the proper boundary (s 12(2)(h)), and may re-open and correct or vary agreements arrived at under the Act, including deemed agreements (s 12(2)(d)).

Debt recovery and other civil remedies

• Debt actions: A landlord’s recovery of contribution from a tenant is framed as recovery of a debt due to the landlord (s 14(1)). A person who has incurred costs in repairing fence damage caused by a wrongful act may recover those costs as a debt from the wrongdoer (s 16(2)). These causes of action proceed as ordinary civil debt claims.
• Proceedings where adjoining owner unknown: If the proponent proceeds under s 9 by affixing a notice because the adjoining owner’s whereabouts are unknown, subsequent discovery of the adjoining owner permits the proponent to institute proceedings for recovery (s 9(3)(a)) or to enforce an earlier order (s 9(3)(b)). The court may then order payment as it considers just (s 9(4)).

Procedural enforcement constraints

• Formal service requirement: Notices must be signed and served personally or by registered post (s 19). Improper service may nullify entitlement to proceed or a deemed agreement and so affect enforceability of subsequent recovery attempts.
• Timing constraints and lapsing: The entitlement to proceed is time-bound (s 8). Failure to comply with timing rules or lapsing by inaction may affect the enforceability of claimed contributions.
• Magistrates Court jurisdictional limits: s 23(4) places limits on the court’s discretionary powers in “minor civil actions” under the Act, preventing the court in that jurisdiction from exercising powers to disregard a requirement of the Act or to provide a special form of relief that would otherwise only be available under the Magistrates Court Act 1991. This affects the scope of relief available in lower-value matters.

No criminal penalties in the text

• The Act’s text does not create criminal offences or specify fines or imprisonment. The remedies provided are civil: orders for payment, apportionment of cost, costs orders, access directions and removal orders (s 12). The Act expressly contemplates debt recovery avenues and court enforcement rather than penal sanctions.

Practical enforcement pathways and limits

• Execution of civil orders: Orders for payment or removal can be enforced by standard mechanisms applicable to Magistrates Court orders (writs, garnishee, seizure, etc.), though the Act itself does not specify ancillary enforcement mechanisms; those follow from general civil procedure.
• Recovery against wrongdoers: s 16(2) expressly converts liability for wrongful damage into a debt recoverable by the adjoining owner who has properly incurred repair costs.
• Post-construction recovery where owner found: The Act contemplates delayed enforcement where an adjoining owner’s identity or whereabouts are discovered after the proponent has lawfully proceeded under s 9, and gives the court discretion to order payment (s 9(3)-(4)).

In summary, enforcement is exercised through the Magistrates Court’s civil powers, debt recovery processes and court orders for access, removal and apportionment. The Act sets procedural prerequisites that, if unmet, constrain the availability or success of enforcement actions.

The Act expressly situates itself within the broader legal framework and sets boundaries for interaction with other legislation and doctrines.

Relationship with the Real Property Act and adverse possession

• Non-derogation from adverse possession rules: Section 17 states that where a dividing fence is erected otherwise than on the boundary pursuant to an agreement under the Act or a court order, occupation of the land enclosed by the fence does not constitute adverse possession giving title in derogation of the other’s title under the Real Property Act. That provision prevents fencing agreements/orders under this Act from creating de facto title changes via prescription or adverse possession.

Preservation of other statutory powers

• Non-derogation clause: Section 25 declares that the provisions of the Fences Act shall not be construed as derogating from powers conferred by any other Act upon any authority, body or person. That preserves other statutory powers (for example planning, environmental, Crown land management or road authority powers) and indicates that the Act is intended to operate alongside other statutory regimes.

Application to Crown and council land and regulation

• Overlap with Crown and council responsibilities: The Act applies to Crown lands and council land except where exemptions apply: land parcels over one hectare, public roads or road reserves, or where regulation exempts the land (s 20(1)-(3)). This creates interaction points with Crown Lands Act, statutory instrumentality responsibilities and local government powers. The Governor can make regulations exempting classes of Crown or council land (s 20(3)), so subordinate legislation may narrow or expand overlap.

Magistrates Court procedure and civil rules

• Court procedure alignment: Section 24 allows rules of court regulating practice and procedure in proceedings under this Act to be made subject to and in accordance with the Magistrates Court Act 1991. The legislative history notes prior amendments to align the “court” with the Magistrates Court. Thus, the Act’s proceedings operate within the procedural architecture of the Magistrates Court and related civil procedure rules.

Impact on prescriptive rights and historical obligations

• Extinguishment of prescriptive fencing rights: Section 21 extinguishes any prescriptive obligation to fence or maintain a fence. That removes reliance on historical prescriptive obligations and shifts reliance onto statutory processes and agreements under the Act and common law contractual or tortious remedies. It affects property law doctrines where prescriptive duties might have applied.

Interaction with landlord-tenant law and sale agreements

• Augmentation of purchase price and landlord recovery: Section 14(3) permits a former landlord to recover as a debt from a former tenant amounts paid by the landlord during tenancy for fencing work in augmentation of a fixed purchase price, tying into contract rights under sale and purchase agreements. Section 14(2) prescribes apportionment principles that will interact with lease terms and any contrary agreement.

Relation to civil remedies for wrongs

• Wrongful damage liability: Section 16(2) provides a debt remedy against persons whose wrongful acts or defaults caused fence damage. This complements tortious remedies for property damage and allows recovery of repair costs under the Act as a statutory civil remedy.

Regulation and local environment/land clearing laws

• Clearing scrub: Section 22 gives a proponent the right to clear scrub up to two metres on each side of the fence as part of the cost of fencing work, subject to regulation by the Governor that can exempt land or kinds of land. That intersects with environmental protection, native vegetation and local government controls over land clearing , relevant statutory regimes may impose permit requirements or prohibitions that constrain exercise of s 22 rights if regulations have been made.

Limits and procedural cross-effects

• Minor civil action limits: Section 23(4) restricts the court’s ability in minor civil actions under this Act to exercise discretionary powers that would otherwise be available only under the Magistrates Court Act 1991. That imposes limits on remedies in small-value disputes and therefore interacts with jurisdictional thresholds under the Magistrates Court Act.

In short, the Act is intended to operate alongside property, environmental, local government and civil procedure laws. It provides specific statutory processes for fencing disputes but expressly preserves other statutory powers and modifies certain common-law doctrines (prescription, adverse possession) to prevent overlap creating unintended title changes.

The legislative history attached to the Act documents a sequence of amendments from its assent in 1975 to changes up to 2023. The history is important because it identifies changes in who the “court” is, additions of procedural and substantive provisions, and recent amendments affecting prescriptive rights and court rule-making.

Key entries from the provided legislative history:

• Fences Act 1975 (No 44), assented 10 April 1975, commenced 16 October 1975. This is the principal Act repealing the Fences Act 1924 and amendments to 1926 (Schedule and s 3 preserving some prior proceedings).
• Fences Act Amendment Act 1977 (No 23): inserted s 3(3) and made other adjustments commencing from the principal Act’s commencement (16 October 1975).
• Fences Act Amendment Act 1983 (No 63): amended s 13 in 1983 (specifics not shown in this consolidation) and other changes.
• Statutes Repeal and Amendment (Courts) Act 1991 (No 69): substituted the definition of “court” with reference to the Magistrates Court (s 4(1): “court” substituted by 69/1991 s 12(a), commenced 6 July 1992) and deleted or substituted other sections (s 13 substituted or deleted).
• Fences Act Amendment Act 1990 (No 57): inserted s 12A (variation of cost of work on appeal) and made other changes, commencing 6 June 1991.
• Statutes Amendment (Attorney-General's Portfolio) Act 1995 (No 27): amended s 14 and inserted s 23(4), with s 14 commencing 10 July 1995.
• Statutes Amendment (Attorney-General's Portfolio) Act 1997 (No 59): amended s 12(8) and inserted s 12(10); substituted s 16(1) and made other related adjustments; parts of Pt 5 (ss 7 & 8) commenced 14 September 1997.
• Statutes Amendment (Attorney-General's Portfolio and Other Justice Measures) Act 2023 (No 4): amended s 24 and added Pt 9 (s 21) , s 21 (extinguishment of prescriptive fencing rights) commenced 22 June 2023 (Gazette 15 June 2023 p1774).

What these entries show, on the face of the Act:

• The designation of the Magistrates Court as the relevant forum is a post-1975 substitution (1991 amendment).
• The Act has received targeted amendments over time to clarify court powers (s 12 and subclauses adjusted in 1997), to allow cost variation on appeal (s 12A in 1990), to regulate landlord-tenant rights (s 14 updated 1995), and to limit minor civil action discretion (s 23(4) inserted 1995).
• The most recent listed amendment (2023) expressly extinguished prescriptive fencing rights by inserting s 21 and updated rules-of-court provisions (s 24 amended), indicating a statutory choice to remove prescription as a basis for fencing obligations and to update procedural rule-making references.

The legislative history as provided is the authoritative record in the text. Any further changes beyond those listed in this legislative history are not reflected in the supplied consolidation.

The text of the Fences Act 1975 supplied here contains no citations to judicial decisions or named cases. It does not include reported litigation excerpts or judicial interpretations. The Act provides a statutory route to the Magistrates Court for dispute resolution (s 12) and contemplates appeals and the capacity of an appellate court to vary cost determinations on appeal (s 12A), but it does not itself record any cases.

Consequently, there is no litigation history embedded in the Act document to analyse for judicial gloss, precedent or interpretative trends. Practitioners should note:

• The Act leaves significant discretionary determinations to the Magistrates Court (s 12). Judicial construction of terms like “adequate fence”, “benefit”, the measure of reasonable cost and reasonable survey or labour allowances will be material to outcomes. The Act itself defines “adequate fence” in s 12(8), but factual application is a matter for courts.
• s 12(6) creates a presumption of equal benefit; the practical application of that evidential presumption and its rebuttal will be matters handled in court; the Act does not specify evidentiary thresholds.
• s 21 (extinguishment of prescriptive fencing rights) and s 17 (prevention of adverse possession arising from fence placement under Act agreements/orders) are statutory overrides of common-law doctrines; litigation would be the mechanism to test the limits of these overrides in factual scenarios not envisaged by the legislature.

To understand how courts have applied the Act in practice, one must search reported Magistrates Court decisions and, where appealed, decisions from appellate courts that address s 12 determinations, s 12(6) apportionment by benefit, the “adequate fence” rule in s 12(7)-(8), and s 21 implications. The Act itself does not provide that jurisprudence.

The Act contains many procedural and substantive traps for practitioners who do not follow its prescriptions closely. Below are concrete pitfalls grounded in the statutory text.

Formalities and service

• Strict service methods: Notices must be signed and served personally or by registered post (s 19). Service by ordinary post or electronic means is not authorised by the Act and may therefore fail to create the proponent’s statutory entitlement to proceed. Form non-compliance may be cured if substantially compliant (s 23(1)), but reliance on that is risky.
• Deemed agreement risk: Failure by an adjoining owner to serve a cross-notice within 30 days results in deemed agreement to proposals or counter-proposals (s 6(1)-(2), s 7). Practitioners must track the 30‑day window from the date of service carefully.

Proceeding too early or recovering costs incorrectly

• No recovery for pre-entitlement work: Unless other provisions apply, a proponent cannot recover contributions for work performed before becoming entitled to proceed under s 8(1) (s 8(2)). A proponent who proceeds before the 30‑day period expires, or before agreement or court adjudication where required, risks being unable to recover contribution.
• Emergency repairs exception: s 16 allows urgent repair without notice and recovery of one-half or the other owner’s liability if replaced, whichever is less (s 16(1)). But the Act is explicit that an owner cannot recover contribution to the extent the damage arose from his own wrongful act (s 16(3)). Practitioners must document urgency and causation.

Unknown or absent adjoining owner

• Affixing notices: If whereabouts of the adjoining owner are unknown after reasonable inquiry, the proponent may affix a notice on a prominent part of the adjoining land (s 9(1)(a)). Affixing a notice allows the proponent to proceed if no cross-notice is served, but creates enforcement complexity later: if the adjoining owner is subsequently found, the proponent may need to sue to recover contribution (s 9(3)-(4)). The “reasonable inquiry” threshold is fact-sensitive and may be litigated.
• No adjoining owner: Where there is no adjoining owner, the proponent must apply to the court (s 10) to obtain an order that when someone becomes owner of contiguous land they must pay a specified amount. Reliance on private contracts or expectations without court order will lose statutory recourse.

Cost definitions and evidence

• Broad cost inclusions: “Cost” expressly includes survey costs, facilitative work and a reasonable allowance for labour where the owner does work personally (s 4(1): “cost”). Practitioners should itemise claims to include these elements and keep evidence; the court will assess what is “reasonable”.
• Adequate fence valuation trap: Where the work results in an adequate fence, s 12(7) caps contribution as one-half of the minimum cost of an adequate fence absent agreement. The definition of “adequate fence” varies by context (s 12(8)); parties who assume full cost recovery for superior fences may be thwarted.

Entry rights and notice for access

• Entry notice requirement: s 18(2) requires at least two days’ written notice before entry to perform authorised fencing work unless in an emergency. Failure to give the 2‑day notice could render entry non-compliant with the Act and expose performers to liability; emergency exceptions are narrow.

Landlord-tenant specific pitfalls

• Graduated tenant liability: The tenant’s liability is governed by remaining term thresholds (s 14(2)). Practitioners must compute remaining term at the time of performance to determine tenant exposure. Further, tenants have specified defences (s 14(4)); landlords must ensure tenants had reasonable opportunity to make representations and that the work was necessary due to tenant acts to succeed.
• Augmentation of purchase price: s 14(3) permits former landlords to recover sums paid during tenancy in augmentation of a fixed purchase price. Vendors and purchasers should specifically address fencing costs in sale contracts to avoid post-settlement disputes.

Crown and council exemptions

• Parcel size and public road carve-outs: The Act does not apply to Crown/council land that is a single parcel over one hectare or comprises a public road/road reserve, or land exempted by regulation (s 20(2)-(3)). Practitioners must check whether the land concerned falls into those exclusions or regulatory exemptions.

Prescriptive rights and adverse possession

• Extinguished prescriptive obligations: s 21 extinguishes prescriptive obligations to fence or maintain a fence. Do not assume historic prescriptive duties govern current disputes.
• No adverse possession via fence agreement/order: s 17 overrides adverse possession claims arising from occupation inside fences erected under the Act. Parties cannot convert physical occupation pursuant to the Act into title claims.

Minor civil action limitations

• Limits on relief in minor civil actions: s 23(4) prevents the court in determining a minor civil action under the Act from using discretionary power to disregard an Act requirement or to give a special form of relief that would be available only through the Magistrates Court Act’s minor civil action powers. This limits creative relief in low-value cases.

Appeal cost variation

• Cost variability on appeal: s 12A allows an appellate court to vary cost determinations to account for later cost variations. Parties should preserve evidence of cost variation post-determination if planning appeals.

Overall, the Act’s many procedural prerequisites and the court’s broad discretion mean that missteps in serving notices, computing liabilities, documenting costs and establishing who the proper party is can materially affect recoveries and outcomes.

Compliance with the Fences Act requires careful adherence to the Act’s prescribed forms, timing rules, evidence of service, and recordkeeping. Below is a practical compliance checklist for a proponent or an adjoining owner, with statutory references.

Preliminary steps

• Establish contiguity and ownership: Confirm contiguity per s 4(2) (common boundary or right of way not exceeding one metre) and identify the owner as defined in s 4(1) (freehold proprietor, life tenant, lessee where appropriate, or occupier with owner consent).
• Determine the scope of fencing work: Classify the work as erection of a new dividing fence, replacement, repair or maintenance, or vegetation/watercourse work serving as a fence (s 4(1): definitions).

Preparing and serving notices (proponent obligations)

• Use the prescribed Form: For erection, use Form No 1; for replacement/repair/maintenance, use Form No 2 in the Schedule, and include all required particulars (length/position, nature of fence, cost estimate, amount sought, compensation if line encroaches, contractor details) (s 5(2)-(4)).
• Sign the notice: The notice must be signed by the person giving it or their solicitor, attorney or agent (s 19(1)).
• Effect proper service: Serve the notice personally or by registered post to the adjoining owner (s 19(2)). If the adjoining owner’s whereabouts are unknown after reasonable inquiry, consider affixing the notice to a prominent part of the adjoining land under s 9(1)(a), but document the reasonable inquiry steps in case of later challenge.
• Keep proof: Retain proof of service (signed receipt, registered-post tracking, photographs of affixation and date/time) to establish the start of the 30‑day objection period.

Responding to notices (adjoining owner obligations)

• Timely cross-notice: If objecting, serve a cross-notice in Form No 3 within 30 days after service of the proponent’s notice, identifying the proposals objected to and any counter-proposals (s 6(1)-(2)). Failure to object within 30 days results in deemed agreement (s 7).
• If the proponent objects to a counter-proposal, respond within 30 days (s 6(3)).
• Retain records: Preserve all correspondence, cost breakdowns, contractor quotes and photographs for potential court determination.

Proceeding to perform fencing work

• Do not proceed before entitlement: A proponent may only proceed after (a) 30 days expire from service without a cross-notice, or (b) agreement is reached or the court adjudicates where a cross-notice is served (s 8(1)). Work undertaken before entitlement is, with limited exceptions, not recoverable (s 8(2)).
• Default lapse and completion times: If you become entitled to proceed, commence and complete within 28 days unless a longer period is agreed or ordered by the court (s 8(3)-(4)). If neither party proceeds for the prescribed period, the agreement lapses; absent agreement or court order the default is four months (s 8(5)-(6)).
• Emergency repairs: If urgent repairs are needed, either adjoining owner may undertake them without notice and recover one-half of the cost or the other’s replacement liability, whichever is less (s 16(1)). Document urgency and cause; do not expect recovery where damage results from your own wrongful act (s 16(3)).

Costing and evidence

• Include reasonable survey and facilitative costs: Compile and present a detailed cost schedule including survey costs and any work reasonably required to facilitate fencing work (s 4(1): “cost”).
• Account for owner labour: If an owner performs the work personally, include a reasonable allowance for labour (s 4(1) “cost”).
• Evidence for “adequate fence” valuation: If the fence is an “adequate fence” as defined in s 12(8), prepare evidence to support or rebut the statutory adequacy criteria because s 12(7) caps contribution in certain circumstances.

Court proceedings and dispute resolution

• Court application where appropriate: Apply to the Magistrates Court under s 12 if disputes arise on line, nature, cost, compensation or apportionment. The court can make orders for access, removal, variation, cost apportionment and compensation (s 12(2)).
• Unknown adjoining owner or no adjoining owner: Use s 9(1)(a) affixing option or apply to the court under s 9(2) when identity/whereabouts cannot be ascertained, or apply under s 10 where no adjoining owner exists.
• Preserve appeal evidence: If a cost determination is likely to change materially, preserve cost variation evidence for possible appeal under s 12A.

Access and entry compliance

• Provide entry notice: For authorised fencing work, provide at least two days’ written notice before entering land, unless there is an emergency (s 18(2)). Ensure entry is at reasonable times and minimise harm (s 18(1)-(3)).
• Document authorisation: Keep copies of any agreements or court orders authorising access and the scope of permitted entry (s 18(4): “authorised fencing work”).

Specific roles: landlords, tenants and life tenants

• Landlords: If a landlord undertakes fencing work during a tenancy, calculate tenant liability by reference to remaining term at time of performance per s 14(2) and follow s 14(4) steps to preserve recovery (notify tenant, allow representations).
• Tenants: If faced with a landlord claim, assert the statutory defences in s 14(4) (work not required due to tenant’s act/default; lack of adequate opportunity to make representations; tenant not bound by previous court order).
• Life tenants: If you are a life tenant who paid fencing costs, compute the remainderman’s contribution as the proportion the remainderman’s interest bears to fee simple (s 15).

Other compliance points

• Check for Crown/council exemptions: Prior to serving notices or initiating work adjacent to Crown/council land, verify whether the Act applies or whether the land is excluded under s 20(2) or exempted by regulation.
• Do not rely on prescription: Do not assert prescriptive fencing obligations; s 21 extinguishes such prescriptive rights.
• Respect environmental controls: Section 22 permits clearing scrub up to two metres each side as part of cost, but check for regulatory exemptions under s 22(2) and any environmental or local government clearing restrictions before acting.

Recordkeeping and risk management

• Keep full documentation: maintain evidence of notices, service, quotes, contractor details, photographs pre/post work, survey reports, time-stamped effort logs (for owner-labour), and any communications. Many disputes turn on whether steps required by the Act were taken.
• Consider insurance and indemnities: For contractors and landowners, have written contracts and indemnities addressing responsibility for damage, compliance with notice requirements, and responsibility for removal or rectification ordered by a court.

Following these steps will align behaviour with the Act’s formal requirements and preserve civil remedies where disputes require court adjudication.
