This instrument affects a narrow set of actors through the allocation and labelling of public funds for the 2020-21 financial year.
The Commonwealth executive. The instrument is an executive determination made under the Federal Financial Relations Act 2009 (s 3). It directs how the Commonwealth will index, total and allocate national specific purpose payments to States for two domains: skills and workforce development, and disability services. The Commonwealth, via the responsible agency, will be the decision-maker implementing the payment schedule and making the actual transfers pursuant to the Act and the Intergovernmental Agreement, as referenced in ss 5 and 6.
The States. The instrument directly determines amounts to be paid to each State for the specified purpose. Section 5(3) lists precise dollar entitlements for New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, the Australian Capital Territory and the Northern Territory. Those amounts are declared "for the purpose of expenditure on skills and workforce development" for 2020-21. The instrument therefore affects State fiscal positions by allocating $1,560,567,868.01 among them for that purpose. For disability services, the instrument records the total payable to the States under paragraph 13(2)(c) is $0.00 for 2020-21 (s 6(2)), which removes any SPP transfer under that head for that year.
Service users and policy recipients. The instrument’s effect on end users , for example trainees, employers, persons with disability , is indirect. It changes the quantum of funds that States receive for skills and workforce development. The label in s 5(3) ties those funds to expenditure on skills and workforce development, which means the scale of programs, subsidies, training places or other State-run activities in that domain will be constrained or enabled by the allocated amounts. For disability services, the zero allocation indicates that Commonwealth SPP flows under paragraph 13(2)(c) are not available to States for 2020-21 because of full transition to the NDIS as at the start of that year (s 6(1)(b) and note). The instrument therefore affects the fiscal environment within which States and service providers operate.
Intergovernmental Agreement parties. The instrument relies on the Intergovernmental Agreement and Schedule D for computation methods and for the manner of dividing the total amount between the States (s 5(1), s 5(3), s 6(1)(b)). The IGA is therefore a material document for parties who must understand how the growth factors and apportionment rules were applied. While the instrument cites the relevant IGA paragraphs, it does not reproduce the full IGA obligations or compliance terms. Entities that rely on the IGA to understand conditions or reporting requirements must consult the IGA directly.
Budget and fiscal planning offices. The instrument explicitly uses the estimates published in the 2021-22 Budget for indexation (ss 5(1) and 6(1)(b)). Treasury, budget offices and responsible agencies that compute payments must therefore reference those published estimates when implementing the instrument’s directions. The instrument affects how budget figures for 2020-21 are recorded and reported by requiring the use of those particular estimates.
Others with statutory interest. The instrument clarifies that expressions have the same meaning as in the Federal Financial Relations Act (s 4). Entities that have statutory rights or obligations under that Act, such as auditors, parliamentary budget offices or oversight bodies, may be affected by the change in SPP allocations and the documented method used to derive them.
What the instrument does not directly affect. The instrument does not itself set operational conditions, reporting obligations, or compliance mechanisms for States’ use of the funds beyond the stated purpose label for the skills and workforce development payments. It also does not change the legal existence or rules of the NDIS; it only excludes SPP amounts relating to States that have transitioned to the NDIS and records the consequence for 2020-21 that the total is nil (s 6).
