What it does
This Determination, titled Federal Financial Relations (National Partnership Payments) Determination No.170 (June 2020), fixes Commonwealth payments to the States on a one-off payment date, and itemises the purposes those payments are to serve. Section 2 states the instrument commences on the day it is made. Section 3 prescribes the core legal mechanism: "The amounts specified in the following table are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to" perform three functions, namely: support delivery by States of specified outputs or projects set out in Schedule 1; facilitate the reforms specified in Schedule 1; or reward States for nationally significant reforms set out in Schedule 1. The table headed "Table 1: National Partnership Payments for payment on 9 June 2020" records the payment amounts by State, and Schedule 1 provides itemised payments by program, project and State.
Mechanically, the Determination does three things: it (1) identifies recipient States and territories and quantifies the Commonwealth payment to each (for example New South Wales $878,052,076.00, Victoria $288,031,351.26, total $1,711,293,519.08 as recorded in Table 1); (2) attaches a stated purpose to that payment , linking it to projects, outputs or reforms set out in Schedule 1 (s 3); and (3) provides the Schedule 1 breakout that specifies sectoral and project allocations (Health, Education, Skills, Community Services, Infrastructure, Environment, Other and Contingent Payments), with line item amounts for each State and for particular projects (for example Early childhood education - Universal access to early education: NSW $85,703,005.00; the "Disaster recovery funding arrangements" contingent payment: NSW $621,080,000.00). The Schedule labels some items as contingent payments and contains a mixture of large single-item allocations and many smaller targeted items.
