What it does
This Determination, titled Federal Financial Relations (National Partnership Payments) Determination No.169 (May 2020), specifies a discrete set of National Partnership Payments to be made by the Commonwealth to the States on a single payment date. Section 2 provides that the instrument "commences on the day on which it is made" (s 2). Section 3 sets out the legal mechanism for the payments: "The amounts specified in the following table are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to: (a) support the delivery by the States of specified outputs or projects specified in Schedule 1; (b) facilitate the reforms by the States specified in Schedule 1; or (c) reward the States for the nationally significant reforms specified in Schedule 1" (s 3). The table that follows (Table 1: National Partnership Payments for payment on 21 May 2020) and Schedule 1 together show the destination, label and monetary amount for the payments.
Mechanically, the instrument does three things. First, it identifies the payment date (the table is headed "for payment on 21 May 2020"). Second, it identifies the recipient States and the dollar amounts payable to them on that date. Third, it links each payment to an expressed purpose in Schedule 1, by way of the statutory purpose language in s 3 above. The only amount specified in the table and Schedule 1 is $9,000,000.00 payable to South Australia, within Schedule 1 categorised as a "Contingent Payment" under "Disaster recovery funding arrangements". All other States and Territories are shown with a dash in the table and Schedule 1, and the total aggregate payment equals $9,000,000.00.
The Determination does not include further operational detail such as conditions precedent, performance milestones, reporting obligations, enforcement powers, recovery mechanisms, or procedural requirements for the States to accept or disburse the funds. It therefore operates, within its four corners, as a narrow funding allocation: a single-sum, labelled payment for South Australia linked to a Schedule 1 purpose described as "Disaster recovery funding arrangements", to be paid on the date shown. The instrument does not, within its text, define the meaning of the dash entries in the tables, nor elaborate the contingency that the "Contingent Payments" heading implies.
