What it does
The instrument is a determination under the Federal Financial Relations Act 2009 (the Act, inferred from the instrument’s name). It directs the Commonwealth to pay specified amounts of financial assistance to each Australian state and territory on 7 November 2019. The total sum is $40,262,593.93, allocated across nine jurisdictions. The determination is number 155 in a series, which suggests it is one of many periodic instruments that implement National Partnership Payments.
Section 3 defines three purposes for the payments: (a) to support the delivery by the states of specified outputs or projects; (b) to facilitate reforms by the states; or (c) to reward the states for nationally significant reforms. The payments are thus not general revenue sharing. They are tied grants, meaning the Commonwealth attaches a purpose to the money, although the determination itself does not set out performance milestones or conditions. Those are presumably contained in separate National Partnership agreements, which are not reproduced here.
The Schedule 1 table breaks down the total by sector: Health ($1,700,000.00 to NSW only for Fussell House accommodation), Education ($947,924.00 to ACT only for universal access to early education), Community Services ($2,351,333.33 to WA only for specialist disability services), Infrastructure ($16,392,805.00 spread across NSW, Victoria, WA, Tasmania, ACT in various road, bridge and safety programs), and Environment ($18,870,531.60 to Queensland, WA, Tasmania and NT for pest and disease programs and World Heritage). The largest single item is the $15,770,531.60 for Pest and Disease Preparedness and Response Programs, paid to Queensland, WA and NT. The second largest is the $4,628,756.00 for ARF - IIP - Western Sydney Roads paid only to NSW.
South Australia receives nothing on this determination. The payments are one-off; the instrument does not create ongoing funding. It commences on the date it is made (likely 7 November 2019) and there is no end date or expiry clause, but its effect is exhausted once the payments are made.
