What it does
This determination, made under the Federal Financial Relations Act 2009 (Cth), authorises the Commonwealth to pay $83,601,789.33 to the eight states and territories on 7 August 2019. It is number 152 in a series of such determinations, each dealing with a specific round of National Partnership Payments. The instrument records the amounts each state will receive and the broad policy sectors those payments relate to, as set out in Schedule 1. The payments serve one or more of three statutory purposes: supporting the delivery by states of specified outputs or projects, facilitating reforms by states, or rewarding states for nationally significant reforms. The schedule breaks down the total into six policy areas: Health ($37,630,164), Education ($1,200,000), Community Services ($2,351,333.33), Affordable Housing ($25,480,500), Infrastructure ($3,916,377), and Environment ($13,023,415). Within those areas, individual line items identify specific programmes such as the Community Health and Hospitals Program, the Defence industry school pathways programs, the NT remote Aboriginal investment - remote Australia strategies, the IIP Bridges Renewal Programme-Through States, and the National fire danger rating system. The determination itself does not set out the terms, conditions, or performance metrics attached to any of these payments; those are presumably contained in separate National Partnership Agreements between the Commonwealth and each state. The instrument is purely a spending authorisation, converting budgeted appropriations into legally authorised payments to state treasuries. It commences on the day it is made, which is likely 7 August 2019 or shortly before, and operates for that single payment event. As a legislative instrument, it is subject to disallowance by either House of Parliament under the Legislation Act 2003, though that power is rarely exercised for individual payment determinations.
