What it does
This Determination fixes a single set of national partnership payment amounts to be paid on 13 February 2019. It is titled "Federal Financial Relations (National Partnership Payments) Determination No. 144 (13 February 2019)" (the Determination). Paragraph 2 records commencement: "This determination commences on the day on which it is made." Paragraph 3 prescribes the legal effect of the schedule: "The amounts specified in the following table are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to: (a) support the delivery by the States of specified outputs or projects specified in Schedule 1; (b) facilitate the reforms by the States specified in Schedule 1; or (c) reward the States for the nationally significant reforms specified in Schedule 1."
Mechanically, the Determination does three things, and only those three things are specified in the text:
- It names the instrument (the "Name of determination" section), so the instrument is identifiable by the stated title.
- It fixes the commencement point as the day it is made (s 2).
- It allocates a monetary sum (set out in Table 1 and Schedule 1) to be paid to the State(s) identified, and ties that payment to the stated purposes in s 3 , namely the making by the States of grants of financial assistance to support specified outputs or projects, to facilitate specified reforms, or to reward nationally significant reforms (s 3).
The numeric outcome in the table and Schedule 1 is unambiguous in this text: Queensland is the only State shown as receiving an amount, $109,000,000.00, for "Natural disaster relief" under the Schedule 1 heading "Contingent Payments"; every other State and Territory is shown with a dash in the amount column. The total national partnership payment recorded is $109,000,000.00.
