What it does
This Determination, titled Federal Financial Relations (National Partnership Payments) Determination No. 141 (December 2018), fixes specific cash payment amounts and identifies the States and purposes for which those amounts are to be paid. The instrument begins operation on the day it is made (cl 2) and, in its operative clause, directs that the amounts specified in the attached table are to be paid to the States identified in that table (cl 3). Clause 3 defines the permitted purposes for the payments: to support delivery by the States of outputs or projects specified in Schedule 1; to facilitate the reforms by the States specified in Schedule 1; or to reward the States for the nationally significant reforms specified in Schedule 1 (cl 3(a)-(c)).
Mechanically, the Determination consists of (1) the formal name and commencement clause (cls 1-2); (2) an operative direction that payments be made as specified in the table (cl 3); and (3) Table 1 and Schedule 1 which enumerate the amounts, recipient States and high‑level purposes. Table 1 is captioned as National Partnership Payments for payment on 7 December 2018 and Schedule 1 sets out the amounts by sector and by State for that payment date. The Schedule aggregates payments by broad sectors , Health, Community Services, Infrastructure and Environment , and gives line items (for example Adult Public Dental Services, Infrastructure Investment Programme - Investment Road, IIP Bridges Renewal Programme) with state allocations and column totals.
The Determination does not, within its four short clauses and Schedule, set out payment mechanics beyond the direction in cl 3 that the amounts are to be paid to the States specified. It does not contain express provisions in the text as provided about payment conditions, reporting, milestones, recoupment, timing beyond the label “for payment on 7 December 2018”, nor does it define administrative roles or penalties. The amounts in Schedule 1 aggregate to a Total National Partnership Payments figure of 301,490,420.26 across all States for the payment date specified. That total and the breakdowns are the operative outputs of the instrument as printed.
