What it does
This Determination, titled Federal Financial Relations (National Partnership Payments) Determination No. 137 (August 2018), sets out a one-off schedule of specified payment amounts to be made to Australian States and Territories for a discrete payment date, 7 August 2018. The instrument commences on the day it is made (see Commencement, cl 2). Clause 3 is the operative provision: it directs that the amounts specified in the table are to be paid to the States nominated in that table for the purpose of making grants of financial assistance to support delivery of specified outputs or projects in Schedule 1, to facilitate specified State reforms in Schedule 1, or to reward States for the nationally significant reforms also specified in Schedule 1.
Mechanically the Determination performs three linked functions. First, it identifies beneficiaries, listing the eight jurisdictions by name: New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, Australian Capital Territory and Northern Territory. Second, it fixes exact dollar amounts by jurisdiction. Table 1 and Schedule 1 together list total payments by State and by program line item. The table totals $444,017,366.21 across all States and Territories, with the largest single program allocation labelled Remote Indigenous housing totalling $365,007,000.00 spread across four jurisdictions (Queensland, Western Australia, South Australia and the Northern Territory). Third, it specifies the purpose categories for those amounts, organised in Schedule 1 under headings such as Health, Education, Skills, Community Services, Affordable Housing, Environment and Other. The Determination identifies payment timing explicitly as “for payment on 7 August 2018” (see Table 1 and Schedule 1 headings).
The Determination does not, within its four operative paragraphs and Schedule 1, set out conditions, reporting requirements, enforcement measures, matching-funding requirements, or detailed milestones. It is therefore a mechanically focused instrument that commits specified dollar amounts for a single payment date and designates purposes and project labels for those amounts. The instrument itself provides the legal basis for making the listed payments and allocating them to the jurisdictions and program lines shown in Schedule 1, while leaving implementation detail and any further conditions outside its text.
