What it does
This instrument , the Federal Financial Relations (National Partnership Payments) Determination No. 135 (29 June 2018) , sets out a one-off allocation of National Partnership Payments to Australian States and Territories and a schedule that specifies the projects or outputs connected to those payments. Mechanically, the determination does three things that are explicit in its four operative paragraphs.
- It gives the instrument a name (clause 1).
- It fixes its commencement date as the day on which it is made (clause 2).
- It directs that the amounts shown in Table 1 are to be paid to the States listed in that table for the purposes described in Schedule 1 (clause 3).
- It refers users to Schedule 1 for "further information on these payments" (clause 4).
Clause 3 identifies three distinct stated purposes for the grants: (a) to support delivery by the States of specified outputs or projects set out in Schedule 1, (b) to facilitate the reforms by the States specified in Schedule 1, and (c) to reward the States for the nationally significant reforms specified in Schedule 1. The instrument does not itself set out any additional legal conditions, timeframes for ongoing performance, reporting requirements or enforcement mechanisms inside its four operative clauses.
Table 1 (described in clause 3 and reproduced in the body of the determination) fixes aggregate payment amounts by State for payment on 29 June 2018. The Table 1 figures add to a total of $2,363,778,586.23. Schedule 1 then breaks that total down by program category and by State and Territory, showing line items across sectors such as Health, Education, Skills, Community Services, Infrastructure, Environment and Contingent Payments. The Schedule totals reconcile with Table 1: for example, the Total National Partnership Payments row in Schedule 1 matches the Table 1 state totals and overall total set out in clause 3.
