What it does
This instrument, the Federal Financial Relations (National Partnership Payments) Determination No. 132 (April 2018), fixes a one-off package of Commonwealth-to-State National Partnership Payments to be made on 9 April 2018. Section 2 states commencement is on the day it is made, and section 3 directs that the amounts set out in Table 1 are to be paid to the States listed in that table for the purposes set out in Schedule 1. The purposes are itemised in s 3(a)-(c): payments are made to enable States to make grants of financial assistance to support delivery of specified outputs or projects, to facilitate reforms by States, or to reward States for nationally significant reforms (see s 3).
Mechanically the determination does three things. First, it identifies and authorises specific dollar amounts to be transferred from the Commonwealth to each State (Table 1 and Schedule 1). Second, it ties those transfers to program titles and purposes recorded in Schedule 1 , for example, large allocations designated under "Infrastructure Investment Programme , Investment Road" and named projects such as "ARF - IIP - Western Sydney Roads" and "North Queensland Stadium" (see Schedule 1). Third, it records that Schedule 1 provides further information on the payments (see s 4), making the Schedule an operative part of the instrument for the described payments.
The document is procedural rather than normative. It does not itself specify reporting, repayment, compliance mechanisms, or sanctions, nor does it contain detailed eligibility rules or performance milestones within the text of the determination. It is an enabling payment determination: it identifies amounts and purposes and instructs that those specific amounts are to be paid to the named States on the specified payment date (see Table 1; Schedule 1). The total authorised value in Table 1 and Schedule 1 is $722,561,172.78, broken down by State and by program area in Schedule 1.
