What it does
This instrument, styled Federal Financial Relations (National Partnership Payments) Determination No. 130 (February 2018), records a one‑off schedule of national partnership payments and directs that those amounts be paid to the States listed for specific purposes. The determination formally: (a) gives its prescribed name (cl 1); (b) commences on the day it is made (cl 2); and (c) declares that the amounts in the table that follows are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to support delivery of specified outputs or projects in Schedule 1, to facilitate the reforms specified in Schedule 1, or to reward the States for the nationally significant reforms specified in Schedule 1 (cl 3). The instrument expressly points users to Schedule 1 for further information on the payments (cl 4 and the Schedule heading).
Mechanically, the operative effect in the text is the creation of a list of amounts and purposes and the instruction that those amounts are "to be paid" to the States identified. Table 1 and Schedule 1 set out line items across policy categories such as Health (Essential vaccines), Education (National School Chaplaincy Program), Community Services (Specialist disability services; Transition to NDIS in WA), Affordable Housing (Homelessness), Infrastructure (various rail, road and bridges programs), Environment (Water for the Future), and Other (tourism infrastructure). The aggregate total in the Schedule is $730,849,501.38 for payment on 7 February 2018. The payments are allocated to individual States and Territories by line item; for example, the Infrastructure Investment Programme,Investment Road line item allocates $264,100,000.00 to New South Wales and $76,336,250.00 to Queensland, among other entries.
The determination does not itself set out delivery conditions, eligibility rules, milestone schedules, reporting obligations, sanctions, or payment mechanisms beyond the direction that the amounts are "to be paid" and the specification of purpose categories in Schedule 1. The Schedule contains specific item labels and dollar figures but does not contain textual conditions or performance benchmarks attached to the payments within the document presented. The legal text therefore performs the administrative function of recording and directing specified payments and purposes, without further procedural detail in the instrument itself.
