What it does
This Determination (Federal Financial Relations (National Partnership Payments) Determination No. 128 (December 2017)) fixes one-off National Partnership Payments from the Commonwealth to the States for payment on 7 December 2017. Section 2 provides commencement: the instrument "commences on the day on which it is made" (s 2). Section 3 is the operative provision: "The amounts specified in the following table are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to: (a) support the delivery by the States of specified outputs or projects specified in Schedule 1; (b) facilitate the reforms by the States specified in Schedule 1; or (c) reward the States for the nationally significant reforms specified in Schedule 1" (s 3). Section 4 points to Schedule 1 for further information on the payments (s 4).
Mechanically, the Determination does three things:
- It identifies a single payment event, described in the title and Table 1, "for payment on 7 December 2017". The table and Schedule 1 allocate precise dollar amounts to each State and to specific programs or projects.
- It ties the payments to purposes captured in Schedule 1: health, community services, affordable housing, infrastructure (with several subprograms including an Infrastructure Growth Package and Asset Recycling Fund entries), and environment. Schedule 1 lists line-item amounts per State and per program, culminating in a Total National Partnership Payments figure of $1,222,210,881.20.
- It locates the legal basis for the payments in the determination itself rather than in a separate schedule of conditions within the main text; Schedule 1 "provides further information on these payments" (s 4), and the Schedule contains the program-level allocations and the State breakdowns.
