What it does
This instrument, titled the Federal Financial Relations (National Partnership Payments) Determination No. 127 (November 2017), fixes a set of one-off National Partnership Payments to the Australian States and Territories and specifies the purposes for which those payments are to be provided. The determination commences on the day it is made (clause 2). Clause 3 prescribes that the amounts in the table are to be paid to the States named in that table to enable the States to make grants of financial assistance that do one or more of the following: support delivery of outputs or projects specified in Schedule 1, facilitate the reforms specified in Schedule 1, or reward the States for the nationally significant reforms specified in Schedule 1 (clause 3).
Schedule 1 is the operative schedule that itemises the payments by program area and by State and Territory. The table in Schedule 1 provides lines for program categories including Education, Community Services, Affordable Housing, Infrastructure, Environment, Other, and Contingent Payments. It gives amounts against sub-programs (for example, Independent Public Schools in Victoria, Specialist disability services in multiple jurisdictions, Investment Rail to Queensland) and aggregates totals by program and by State. The schedule records a total of $223,170,415.59 across all jurisdictions for the payment round in question (Schedule 1, Total National Partnership Payments).
Mechanically, this determination does three things: it (1) identifies payees (the States and Territories shown in the table); (2) fixes monetary amounts to be paid to those jurisdictions and allocates amounts to particular program headings (Schedule 1); and (3) ties the payments to defined purposes in Schedule 1 by reference to clause 3. The instrument does not itself set out detailed conditions, reporting requirements, triggers for contingent payments, or enforcement mechanisms within its text. Those details are absent from the determination as published, so the determination operates principally as a payment schedule and purpose statement (clause 3; Schedule 1).
