What it does
This determination (Federal Financial Relations (National Partnership Payments) Determination No. 126 (October 2017)) directs payment of specified sums to the Australian States listed in Schedule 1 and declares the purpose for which those payments are made. The instrument is expressly taken to have commenced on 4 October 2017 (cl 2). It revokes the immediately preceding instrument, Federal Financial Relations (National Partnership Payments) Determination No. 125 (October 2017) (cl 3). Clause 4 sets out the core operative instruction: the amounts specified in the table in Schedule 1 are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to do one or more of the following: support the delivery by the States of specified outputs or projects set out in Schedule 1, facilitate the reforms specified in Schedule 1, or reward the States for nationally significant reforms specified in Schedule 1 (cl 4(a)-(c)). Clause 5 states that Schedule 1 provides further information on these payments.
Schedule 1 is the substantive part of the instrument for practical purposes. It contains a table of National Partnership Payments for payment on 9 October 2017, organised under program headings (Health; Community Services; Affordable Housing; Infrastructure; Environment; Contingent Payments). The table lists individual line items, indicates (by means of notation in the table) which line items are National Partnership Payments, and records monetary allocations by State and Territory, with a per‑item total and an overall Total National Partnership Payments figure. The final totals row in Schedule 1 records the sum to be paid to each State and Territory and the aggregate total: for example, NSW is shown as the recipient of $152,014,149.49; Victoria $23,187,107.11; Queensland $96,965,014.65; Western Australia $23,967,719.13; South Australia $19,679,498.48; Tasmania $16,236,070.84; the Australian Capital Territory $504,014.22; the Northern Territory $1,394,038.35; and the grand total $333,947,612.27 (Schedule 1 table). The schedule records some large, concentrated payments (for example, a Natural disaster relief figure of $101,675,795.00 to NSW under ‘Contingent Payments’) and numerous smaller line items (for example, “Essential vaccines” with minor amounts for most jurisdictions but $444,038.35 recorded for NT).
