What it does
This instrument, the Federal Financial Relations (National Partnership Payments) Determination No. 124 (September 2017), sets out a one-off allocation of Commonwealth National Partnership payments to the States and Territories and specifies the purposes for which those payments are to be made. Section 2 provides the commencement rule, the determination commencing on the day on which it is made. Section 3 prescribes the legal direction: "The amounts specified in the following table are to be paid to the States specified in that table for the purpose of making a grant of financial assistance to: (a) support the delivery by the States of specified outputs or projects specified in Schedule 1; (b) facilitate the reforms by the States specified in Schedule 1; or (c) reward the States for the nationally significant reforms specified in Schedule 1."
Schedule 1 is the operative schedule of the determination and lists individual line items by sector (Health; Community Services; Affordable Housing; Infrastructure; Environment; Contingent Payments) and the dollar amounts to be paid to each State and Territory for each line item, and aggregates by State and by sector. The table is titled "National Partnership Payments for payment on 7 September 2017" and the Schedule records the total National Partnership payments as $252,151,358.94 distributed across States and territories.
Mechanically, the instrument does three things: it fixes quantum by line item and State; it fixes a stated purpose for those sums (support delivery, facilitate reforms, or reward nationally significant reforms as per s 3); and it designates the payment date in the table heading as 7 September 2017. The Schedule contains line items that identify particular projects or programs (for example "OzFoodNet", "Improving Local Access to Healthcare on Phillip Island", "Black spot projects", "Home and community care", and "Natural disaster relief") together with per‑State dollar figures. The Schedule also contains a negative entry under "Investment Rail" for Western Australia of (4,083,000.00), which appears in the arithmetic aggregation of program totals.
