What it does
This instrument, titled Federal Financial Relations (National Partnership) Determination No.162 (February 2020), fixes a set of Commonwealth payments to State governments and specifies the purpose for which those payments are made. Clause 2 states the determination commences on the day it is made. Clause 3 directs that the amounts specified in the Table (Table 1) are to be paid to the States listed in that Table for one or more of three purposes: to support the delivery by the States of specified outputs or projects set out in Schedule 1, to facilitate reforms by those States specified in Schedule 1, or to reward the States for nationally significant reforms specified in Schedule 1 (cl 3(a)-(c)). Table 1 is captioned as “National Partnership Payments for payment on 12 February 2020” and the table in the body of the instrument shows numeric amounts for Victoria ($3,000,000), Queensland ($1,500,000) and Western Australia ($1,000,000), with the other jurisdictions shown as “-”. The table aggregates to a total of $5,500,000. Schedule 1 reproduces the same breakdown and identifies the program area as Environment and the project or output as “Bushfire Wildlife and Habitat Recovery”.
Mechanically, the determination does three things: it names the instrument, sets its commencement date, and prescribes a one‑off set of payments on a specified payment date for use in delivering or facilitating outputs or reforms listed in Schedule 1. The instrument does not itself set out detailed grant conditions, payment schedules beyond the single payment date shown, reporting requirements, enforcement mechanisms, or recipient‑level eligibility criteria within the text provided. The Schedule identifies the purpose (Bushfire Wildlife and Habitat Recovery) and allocates the $5.5 million total across three States (VIC, QLD, WA) (Table 1; Schedule 1). The instrument thereby authorises the Commonwealth to disburse the specified sums to the States for the stated purposes and leaves the States to make grants of financial assistance in pursuit of those purposes (cl 3).
