What it does
This instrument, titled Federal Financial Relations (National Partnership) Determination No.160 (January 2020), is a short, purpose-specific determination that fixes a single round of National Partnership payments. The instrument formally names itself (see the Name of determination entry) and commences on the day it is made (Commencement, cl 2). Clause 3 (Determination) directs that "the amounts specified in the following table are to be paid to the States specified in that table" for three stated categories of purpose: to support delivery by the States of specified outputs or projects; to facilitate the reforms by the States specified in Schedule 1; or to reward the States for the nationally significant reforms specified in Schedule 1 (s 3).
Mechanically, the instrument performs two functions. First, it creates an entitlement in favour of the State(s) identified in Table 1 by specifying the amount(s) to be paid and the date for payment. Table 1 is headed "National Partnership Payments for payment on 21 January 2020", which fixes the operative payment date. Second, it links those payments to purposes listed generically in s 3 and concretely in Schedule 1, which supplies the only additional detail in the instrument about the subject matter of the payments.
In practice, the determination results in a single payment entry: Schedule 1 and Table 1 together record a contingent National Partnership payment of $1,000,000.00 to Victoria for "Disaster recovery funding arrangements", labelled under the table as "Contingent" and summed as the Total National Partnership Payments of $1,000,000.00. The determination contains no further operational clauses, conditions, reporting obligations, enforcement procedures, or administration provisions within the instrument itself. Schedule 1 is the only annexed schedule and its content is confined to a table that repeats the payment amount, its categorisation as contingent, the purpose label "Disaster recovery funding arrangements", the recipient (Victoria), and the total.
