What it does
This determination, made under the Federal Financial Relations Act 2009, authorises the payment of $42 million in total to four Australian states as National Partnership Payments. It is titled "Determination No.159 (January 2020)" and commences on the day it was made. The payment is classified as a contingent payment under the "Disaster recovery funding arrangements" category. The amounts are allocated to New South Wales ($33 million), Victoria ($2 million), Queensland ($5 million), and South Australia ($2 million). Western Australia, Tasmania, the Australian Capital Territory, and the Northern Territory receive nothing.
The legal effect is to establish the Commonwealth's authority (and obligation, subject to any conditions in the underlying agreement) to disburse these funds on 10 January 2020. Clause 3 states the purpose: to make a grant of financial assistance to (a) support delivery by the states of specified outputs or projects specified in Schedule 1; (b) facilitate reforms by the states specified in Schedule 1; or (c) reward the states for nationally significant reforms specified in Schedule 1. The determination does not distinguish which of these three purposes applies to the disaster recovery payments. It lumps them together, meaning a single $42 million grant could simultaneously be intended to support disaster recovery outputs, facilitate state reforms, and reward prior reforms. The effect is to give the Commonwealth broad discretion to allocate funds under any of those rationales, even though Schedule 1 only mentions one functional category. The determination does not set out any conditions the states must satisfy to receive the money; those are presumably contained in the relevant national partnership agreement referenced by the Act. The instrument merely records the payment amounts and triggers disbursement.
