This Determination directs the Commonwealth to credit specified amounts to the COAG Reform Fund and to pay those amounts to the States on 21 June 2017 as general purpose financial assistance that States may use for any purpose. It points to the Intergovernmental Agreement (Schedule D) for payment terms and records a $5,000,000,000 debit limit for the 2016–17 year, confirming cumulative payments do not exceed that cap.
This Determination, Federal Financial Relations (General Purpose Financial Assistance) Determination No. 99 (June 2017), is a legislative instrument made by the Assistant Minister to the Treasurer under section 9 of the Federal Financial Relations Act 2009 (the Act). The Determination mechanically does three primary things.
First, it authorises specific amounts to be credited to the COAG Reform Fund and then paid to the States on 21 June 2017 as grants of general purpose financial assistance (see para 10). The Determination directs that the amounts specified in Table 1 (reproduced as an image in the instrument) are to be credited to the COAG Reform Fund before being paid to the States named in that table for the purpose of making general purpose grants.
Second, it records and applies the statutory constraints in the Act governing these payments. The Determination explicitly relies on subsection 9(1) of the Act as the head of power for determining the amounts (para 10), and notes the operation of subsection 9(2) which requires amounts determined under subsection 9(1) to be credited to the COAG Reform Fund (para 6). It also references subsection 9(3) in relation to an annual debit limit, and subsection 9(5) in relation to the instrument’s status as a legislative instrument (paras 12, 4).
Third, it places the payments in the administrative architecture established by other statutes and agreements. It records that the COAG Reform Fund was established by the COAG Reform Fund Act 2008 and is a Special Account for the purposes of the Public Governance, Performance and Accountability Act 2013 (para 7). It records that subsection 7(2) of the COAG Reform Fund Act 2008 requires the terms and conditions of payments to be set out in a written agreement between the Commonwealth and each State (para 8), and that the Intergovernmental Agreement on Federal Financial Relations (IGA) contains the relevant payment arrangements (para 9). Schedule 1 summarises relevant agreement headings (for example compensation to Western Australia for royalty impacts, ACT municipal services compensation, Snowy Hydro taxation compensation, and offshore petroleum royalty sharing).

Finally, the Determination includes an express exemption from disallowance under section 42 of the Legislative Instruments Act 2003: subsection 9(5) of the Act is recorded as providing that this instrument is a legislative instrument but that section 42 of the Legislative Instruments Act 2003 does not apply (para 4). The instrument commences on the day it is made (para 2) and is dated 19 June 2017.
In short, the Determination effects immediate one-off payments to States by: setting the amounts (Table 1), requiring crediting to the COAG Reform Fund consistent with the Act (paras 6, 10), ensuring the payments fit within the statutory debit limit (paras 12-14), and linking payments to the written agreement and IGA terms that govern the conditions of those payments (paras 7-9; Schedule 1).
Main concepts
The Determination organises a small set of legal and administrative concepts that determine how general purpose financial assistance flows from the Commonwealth to the States. These concepts are embedded in the instrument’s text and in the statutory and intergovernmental framework it incorporates.
Source power and legal character. The Determination is made under section 9 of the Federal Financial Relations Act 2009. The instrument repeatedly refers to "the Act" as the source of authority (paras 5, 6, 10). The instrument is therefore an exercise of the Commonwealth’s delegated determination power under that Act to determine amounts of general purpose assistance for States.
COAG Reform Fund as the payment vehicle. The instrument mandates that amounts determined under s9(1) must be credited to the COAG Reform Fund before payment (para 6). The COAG Reform Fund was established by the COAG Reform Fund Act 2008 and is a Special Account for PGPA Act 2013 purposes (para 7). The Determination therefore uses the Special Account architecture required by the PGPA Act to hold and disburse funds.
General purpose financial assistance. The Determination invokes the category "general purpose financial assistance", defined in context as financial support "to be used by the States for any purpose" (para 5). That phrase indicates these payments are not tied to specific programs or activities in their use, although the instrument also explains that terms and conditions for payments are set by written agreements and the IGA (paras 8-9 and Schedule 1).
Written agreements and the Intergovernmental Agreement. The instrument points to subsection 7(2) of the COAG Reform Fund Act 2008, which requires that terms and conditions for assistance paid through the COAG Reform Fund be in a written agreement between the Commonwealth and a State (para 8). It then identifies "Schedule D , Payment Arrangements" of the Intergovernmental Agreement on Federal Financial Relations (the IGA) as containing the terms and conditions for general purpose financial assistance, and states that Schedule 1 of the Determination summarises relevant IGA provisions (para 9, Schedule 1).
Debit limit and fiscal constraint. The Determination implements the numerical fiscal constraint in subsection 9(3) of the Act, which caps the total amount credited to the COAG Reform Fund for general purpose grants in a financial year. The instrument reproduces that constraint for the 2016-17 year as a $5,000,000,000.00 limit and then records cumulative determinations (paras 12-14, Table 2).
Parliamentary oversight exemption. The instrument explicitly records that subsection 9(5) of the Act makes the Determination a legislative instrument but that section 42 (disallowance) of the Legislative Instruments Act 2003 does not apply (para 4). The instrument therefore removes the parliamentary disallowance process for this kind of determination, as provided for in the Act.
Schedule-level detail. Schedule 1 summarises specific payment streams delivered as general purpose assistance: compensation for loss of royalties due to an excise amendment affecting condensate (Western Australia), ACT municipal services payments, Snowy Hydro tax compensation to NSW and Victoria, and royalty payments under the Offshore Petroleum and Greenhouse Gas Storage Act 2006 shared with Western Australia (Schedule 1 table). Schedule 2 and Tables 1 and 2 are used to list numeric payment entries and cumulative totals for the financial year; these are reproduced as images in the instrument.
Each of these concepts establishes who decides (Assistant Minister under s9), where the money sits administratively (COAG Reform Fund Special Account under PGPA Act), who receives it (States, including ACT and NT), what the money is for (general purpose), what legal constraints apply (written agreements per COAG Reform Fund Act and IGA; annual debit limit per s9(3)), and what parliamentary process is limited (no disallowance under s42 LIA 2003).
Who it affects
This Determination affects several discrete groups and institutional actors through its mechanics.
The States and Territories. The primary recipients are the States named in Table 1, with the instrument explicitly defining "State" to include the Australian Capital Territory and the Northern Territory (para 3). The Determination instructs the Commonwealth to credit specified amounts to the COAG Reform Fund and then pay those amounts to the States on 21 June 2017 for the purpose of making grants of general purpose financial assistance (para 10). Those States receive funds that the instrument describes as usable "for any purpose" (para 5), subject to written agreements and the IGA payment arrangements (paras 8-9; Schedule 1).
The Commonwealth Executive (Treasury/Departmental officials). The Commonwealth must perform the administrative steps required by the Act and the Determination. That includes crediting the specified amounts to the COAG Reform Fund prior to payment (para 10; para 6 referencing s9(2)), ensuring the total credits in the financial year do not exceed the debit limit set by subsection 9(3) of the Act, and making the payments on the specified date (paras 12-14). Commonwealth officials must also observe that the COAG Reform Fund is a Special Account under the PGPA Act (para 7) and ensure written agreements cover terms and conditions (para 8).
The Assistant Minister to the Treasurer. The instrument is signed and dated by Michael Sven Sukkar as the Assistant Minister to the Treasurer (front matter). As the decision-maker making a determination under section 9, the Assistant Minister is the Commonwealth decision authority who sets the specified amounts in this instance (para 10).
Treasury and agencies responsible for special accounts and financial governance. Because the COAG Reform Fund is a Special Account under the PGPA Act (para 7), agencies responsible for Special Account administration have compliance and reporting obligations under the PGPA Act framework when handling credited amounts and disbursements.
Bodies named in Schedule 1 as the subjects of particular payment streams. While payments are general purpose in legal character, Schedule 1 lists specific payment arrangements that will be delivered through the general purpose mechanism. These include Western Australia (compensation for royalties impacted by an excise amendment), the Australian Capital Territory (municipal services payments), New South Wales and Victoria (Snowy Hydro taxation compensation), and Western Australia again for offshore petroleum royalties (Schedule 1 table). Those States have identified fiscal interests captured by the listed payment arrangements.
Parliament and Senators/MPs. The instrument records that section 42 of the Legislative Instruments Act 2003 (disallowance) does not apply to this Determination because subsection 9(5) of the Act exempts it (para 4). Practically, this reduces the scope for parliamentary procedural oversight that would otherwise allow disallowance of the instrument, affecting parliamentary scrutiny of these payments.
Legal and compliance advisers. Because the Determination ties the payment conditions to written agreements and the IGA (paras 8-9), legal teams representing States and Commonwealth officials must consult and negotiate those written agreements to reflect the payment arrangements summarised in Schedule 1 and contained in Schedule D of the IGA.
Auditors and public accountants. The use of a Special Account under the PGPA Act will engage audit, reporting and accountability mechanisms. The instrument’s instruction to credit the COAG Reform Fund places the funds into an account regime subject to PGPA Act reporting and auditing.
Who does not appear in the instrument as directly affected are individual program recipients, service providers and program managers. Because the payments are cast as general purpose financial assistance "to be used by the States for any purpose" (para 5), the Determination does not attach specific programmatic obligations or conditions at the Commonwealth level within the instrument itself, though terms and conditions are to be found in written agreements and the IGA Schedule D (paras 8-9, Schedule 1). This broad character changes the locus of operational effect to State governments and their internal budgets.
Key duties and rights
The Determination creates or confirms a set of duties and rights that flow from the statutory and intergovernmental framework it invokes. The duties are mostly administrative and fiscal; the rights concern receipt and usage by the States, and certain procedural privileges for the Commonwealth.
Duties imposed or referenced in the Determination
Duty to credit to the COAG Reform Fund. Subsection 9(2) of the Act obliges that amounts determined under subsection 9(1) be credited to the COAG Reform Fund. The Determination records and applies that requirement: the amounts in Table 1 are to be credited to the COAG Reform Fund before payment on 21 June 2017 (paras 6, 10). The administrative duty rests with Commonwealth officials who manage the Special Account and make the disbursement.
Duty to stay within the debit limit. Subsection 9(3) of the Act caps total amounts credited to the COAG Reform Fund for general purpose assistance in a financial year. The Determination reproduces the limit for 2016-17 as $5,000,000,000.00 (para 12) and records that the cumulative amounts determined in the financial year (Table 2) do not exceed that limit (paras 13-14). The duty is a binding fiscal control on the Commonwealth’s determinations for the year.
Duty to use written agreements for terms and conditions. The COAG Reform Fund Act 2008 , specifically subsection 7(2) as cited in the Determination , requires that terms and conditions on which assistance is granted through the COAG Reform Fund be set out in a written agreement between the Commonwealth and the State (para 8). The Determination therefore embeds a contractual or quasi-contractual duty to document payment conditions separately from the Determination itself.
Administrative duties under PGPA Act. By identifying the COAG Reform Fund as a Special Account for PGPA Act 2013 purposes (para 7), the Determination brings with it the routines and obligations of Special Account management under the PGPA Act. Those obligations include financial reporting and stewardship consistent with PGPA requirements, although the Determination does not reproduce PGPA provisions.
Rights referenced or implied by the Determination
States’ right to receive funds. The Determination explicitly authorises specified amounts to be paid to named States (Table 1) for general purpose assistance (para 10). The right to payment arises from the Determination and the statutory scheme that permits the Commonwealth to determine and make such payments.
States’ broad discretion in use of funds. The Determination states that the purpose is to provide financial support "to be used by the States for any purpose" (para 5). That phrase creates an operational right for recipient States to allocate and use the received funds without program-specific restrictions set in the Determination.
Right to terms and conditions in written agreement. While the Determination grants broad discretion to States in the use of funds, it also requires that terms and conditions be set out in written agreements as required by the COAG Reform Fund Act 2008 (para 8). Those written agreements will set rights and obligations between the Commonwealth and each State, including any conditions that might constrain the exercise of the broad use right.
Commonwealth procedural right under subsection 9(5). The Determination records that subsection 9(5) of the Act renders it a legislative instrument but that section 42 disallowance does not apply (para 4). That provision is a procedural right residing with the Commonwealth (or the instrument-maker) to make determinations that are not subject to parliamentary disallowance under the Legislative Instruments Act 2003.
What the Determination does not do, and the consequential negative duties or absence of rights
It does not impose detailed performance reporting or programmatic conditions within the text of the Determination. Those matters are to be covered by written agreements and the IGA’s Schedule D (para 9). This means the Determination itself imposes no specific performance reporting duties on States, beyond what those written agreements may require.
It does not create penalties or enforcement mechanisms within the instrument. The Determination contains no sanctioning provisions nor does it state enforcement processes; any enforcement or recoupment mechanism would need to be located in the written agreements, the IGA, the COAG Reform Fund Act, the PGPA Act, or other applicable law.
Procedural summary of who owes what to whom
Commonwealth officials owe the duty to credit the determined amounts to the COAG Reform Fund and ensure payments follow the special account rules and do not breach the debit limit (paras 6, 7, 12-14).
States have the right to receive funds and the discretion to use funds for any purpose, but they are also subject to the terms and conditions negotiated in written agreements pursuant to subsection 7(2) of the COAG Reform Fund Act 2008 (paras 5, 8).
The instrument-maker, the Assistant Minister, exercises the statutory right to make determinations under the Act and does so in a manner that is not subject to parliamentary disallowance (paras 4, 10).
Penalties and enforcement
The Determination itself contains no express penalty provisions or enforcement mechanisms. The instrument is primarily an authorising and administrative measure that allocates amounts to the COAG Reform Fund and directs payment to States. Where the Determination references constraints or processes that could give rise to enforcement, those mechanisms are located in other statutes and intergovernmental instruments which the Determination incorporates by reference.
What the Determination says about enforcement-related architecture
Written agreement as the locus for terms and conditions. The Determination quotes subsection 7(2) of the COAG Reform Fund Act 2008 as requiring that the terms and conditions on which financial assistance is granted through the COAG Reform Fund be set out in a written agreement between the Commonwealth and the State (para 8). Any enforceable obligations, conditions precedent for payment, or clauses giving the Commonwealth a right to suspend, claw back, or require repayment would be in those written agreements. The Determination itself does not specify such clauses.
Intergovernmental Agreement (Schedule D). The Determination identifies Schedule D , Payment Arrangements of the IGA as containing the terms and conditions for payments of general purpose financial assistance (para 9). The IGA is itself an intergovernmental instrument, and Schedule D will spell out arrangements such as payment timing, calculation, and any usual intergovernmental conditions. Enforcement of IGA commitments between the Commonwealth and States is typically political and contractual rather than judicial; the Determination does not alter that architecture.
PGPA Act and Special Account oversight. By noting the COAG Reform Fund is a Special Account for PGPA Act 2013 purposes (para 7), the Determination places the credited funds under the PGPA Act’s financial management and accountability regime. That regime includes audit and reporting obligations, and potentially financial controls that can limit disbursement if PGPA requirements are not met. Any PGPA-related compliance action would flow from the PGPA Act and agency administration processes, not from the Determination itself.
Fiscal limit as a constraint. The Determination cites subsection 9(3) of the Act setting a debit limit for the financial year (para 12). The debit limit acts as an internal legal constraint on the Commonwealth’s capacity to determine and credit amounts; breach of the debit limit would be a legal error and could give rise to administrative consequences or judicial review, but the Determination does not provide a specific sanction.
What the Determination does not do with respect to penalties
It does not create statutory penalties (criminal or civil) for misuse or unauthorised use of funds by States. The Determination says funds are "to be used by the States for any purpose" (para 5), but directs that terms and conditions are to be recorded in written agreements (para 8). Any penalties for misuse would therefore need to be found in those written agreements or in other applicable legislation.
It does not set out an enforcement pathway for breaches of the IGA or the written agreements. The IGA and written agreements determine intergovernmental recourse; the Determination itself does not set procedures to withhold future funding, recover sums, or impose other administrative penalties.
Implications for enforcement risk and audit
Audit and financial accountability will be exercised through the PGPA Act framework, because the COAG Reform Fund is a Special Account (para 7). Auditors and internal financial controllers have a statutory framework to check whether funds were credited and disbursed in line with the Determination and PGPA requirements.
Contractual enforcement between Commonwealth and a State will be exercised through the written agreement and the IGA. Those instruments will govern the availability of contractual remedies, and they are the appropriate place to examine recoupment clauses, offsets, or other enforcement devices.
Parliamentary disallowance is not available as a procedural enforcement or oversight device for this Determination because section 42 of the Legislative Instruments Act 2003 does not apply (para 4). That reduces a particular parliamentary check but does not eliminate other oversight mechanisms such as audit reports, Senate Estimates, or political scrutiny.
In summary, enforcement and penalties are largely located outside the Determination in the COAG Reform Fund Act 2008 (written agreement requirement), the IGA (Schedule D), the PGPA Act (Special Account controls, reporting and audit), and potentially in the terms of individual written agreements. The Determination itself is silent on sanctions or recoupment.
How it interacts with other laws
The Determination expressly situates itself within a network of statutes and intergovernmental instruments. The instrument’s text names the specific legal instruments it depends on or invokes, so interactions are direct and limited to the texts it cites.
Statutes and instruments explicitly referenced
Federal Financial Relations Act 2009. The Determination is made under section 9 of the Act and repeatedly invokes subsections 9(1), 9(2), 9(3) and 9(5) in its operative provisions (paras 5-6, 10-12, 4). The Act provides the primary legal power and constraints for determining, crediting and making general purpose payments to States. The Determination must be interpreted and applied in a manner consistent with the Act.
COAG Reform Fund Act 2008. The Determination records that the COAG Reform Fund was established by this Act and that subsection 7(2) requires terms and conditions on financial assistance to be written agreements between Commonwealth and the State (paras 7-8). The COAG Reform Fund Act determines the legal characteristics of the Fund and the requirement for written agreements to govern assistance paid from it.
Public Governance, Performance and Accountability Act 2013 (PGPA Act). The Determination identifies the COAG Reform Fund as a Special Account for the purposes of the PGPA Act (para 7). That interaction means Special Account rules, reporting obligations, and financial management requirements under the PGPA Act apply to amounts credited to and disbursed from the COAG Reform Fund, thereby imposing statutory financial governance duties on agencies administering the Fund.
Legislative Instruments Act 2003. The Determination records an express exemption from section 42 (disallowance) of the Legislative Instruments Act 2003, via subsection 9(5) of the Act (para 4). This interaction determines procedural parliamentary oversight and removes the disallowance process for this instrument.
Intergovernmental Agreement on Federal Financial Relations (IGA). The Determination relies on the IGA as the source of detailed payment arrangements. It identifies Schedule D , Payment Arrangements , as containing the terms and conditions for payments of general purpose financial assistance (para 9). Schedule 1 summarises elements of Schedule D relevant to payments.
Other statutory or regulatory interactions implied
Offshore Petroleum and Greenhouse Gas Storage Act 2006 and Offshore Petroleum (Royalty) Act 2006. Schedule 1 includes a row on "Royalty payments" and describes the Commonwealth providing general purpose assistance to Western Australia from royalties payable under the Offshore Petroleum (Royalty) Act 2006 in respect of the North West Shelf project, and notes these payment arrangements are in accordance with section 75 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Schedule 1 table). The Determination therefore cross-references offshore royalty statutory arrangements when explaining the provenance of certain payments.
Snowy Hydro Tax Compensation Deed. Schedule 1 notes that taxation compensation payments are made in accordance with the Snowy Hydro Tax Compensation Deed between the Commonwealth, New South Wales and Victoria (Schedule 1 table). That deed is a contractual instrument that determines the entitlement and distribution of those particular payments, outside the Determination’s text proper.
Practical consequences of these interactions
Financial governance is layered. The act of crediting and disbursing funds is authorised by the Federal Financial Relations Act 2009, but actual account handling and reporting fall under the PGPA Act because the COAG Reform Fund is a Special Account (para 7). Agencies must therefore comply with PGPA requirements in operating the Fund.
Terms, conditions and enforcement are located in separate documents. The Determination centralises amounts and the requirement to credit the Fund, but it delegates detailed terms and potential enforcement mechanisms to written agreements and the IGA (paras 8-9). Practitioners must therefore read the written agreements and the IGA’s Schedule D to understand obligations and remedies.
Parliamentary oversight is constrained for this instrument. The Legislative Instruments Act interaction removes disallowance (para 4), which shifts some oversight from a parliamentary procedural device to other oversight mechanisms such as audits, Estimates, and political scrutiny.
Sector-specific statutes can feed into payment design. The reference to offshore petroleum royalty collection and sharing in Schedule 1 demonstrates that other substantive statutes create revenue streams that the Commonwealth can redistribute to States under the general purpose mechanism.
Limits of interaction declared by the Determination
The Determination does not amend or displace the substantive obligations in the referenced statutes. It records and operates within their constraints. For example, the debit limit under s9(3) is enforced by the Determination (paras 12-14) but originates in the Act.
The Determination does not itself contain the full content of intergovernmental or contractual commitments; it refers to them and summarises select items (Schedule 1). For the full legal terms governing payment use, clawback, or conditions, the IGA and written agreements are the operational sources.
Amendment history
The Determination itself is dated 19 June 2017 and states it commences on the day it is made (para 2 and front matter). The instrument’s text contains duplications and repeated sections, consistent with a consolidated or reproduced document, but there is no text within the Determination that records any prior amendments to this Determination nor any subsequent amendments. There is no "Amendments" schedule or footnote listing variations.
What the instrument shows about its creation and lifecycle
Date and maker. The Determination is signed by Michael Sven Sukkar, Assistant Minister to the Treasurer, and dated 19 June 2017 (front matter). The commencement clause states the Determination commences on the day on which it is made (para 2), so operative effect began 19 June 2017.
One-off operational use. The Determination is drafted to authorise a particular set of payments in the 2016-17 financial year to be paid on 21 June 2017 (paras 10-11). The content and repetition indicate the instrument functions as a discrete, event-specific instrument rather than a standing regulatory schedule that would be subject to frequent amendment.
No recorded amendment entries. The Determination does not contain a dedicated amendment history section or notes that the text has been amended. Because it is an instrument made under an Act, any amendment would normally appear as a subsequent legislative instrument or a consolidated instrument indicated on the Federal Register of Legislation. The Determination does not list such follow-up instruments.
Where to look for external amendment history and lineage
The Federal Register of Legislation (ComLaw) would show if the Determination had later instruments that amended it, revoked it, or superseded it. The Determination itself does not list those details.
Amendments to the underlying statutory framework would occur in the Federal Financial Relations Act 2009, the COAG Reform Fund Act 2008, the PGPA Act, or the Legislative Instruments Act 2003. Those statutes may have amendment histories that affect the operation of the Determination, but such statutory amendments would not be recorded in the Determination unless they triggered a republished or amended instrument.
Changes to the Intergovernmental Agreement (IGA) or Schedule D might change terms and conditions applicable to future payments, but the Determination only summarises current Schedule D arrangements without recording modifications.
Practical note for practitioners
To confirm whether this Determination still stands, or whether it has been amended or repealed, consult the Federal Register of Legislation entry for Determination No. 99 (June 2017). The Determination alone provides the date of making and commencement but does not report subsequent changes.
If a practitioner needs to know prior or later action that affects the same payment streams (for example, if the debit limit or treatment of the COAG Reform Fund was changed), check the relevant statutes and any later determinations under s9 of the Federal Financial Relations Act 2009.
Litigation history
The Determination contains no references to litigation, court decisions, or legal challenges. It does not record any judicial consideration of its validity, nor does it cite any litigation concerning the payments or the statutory provisions it implements.
What the instrument indicates and what it does not
No internal record of litigation. The text does not contain any mention of court proceedings, disputes, or legal opinions addressing the Determination’s validity or operation. It also does not indicate that the Determination was made in the context of settled or contested legal questions.
Possible fora for dispute. Although the Determination does not mention litigation, disputes in the intergovernmental financial relations space may be litigated in courts where legal questions arise about statutory powers or contractual obligations. In this Determination, potential litigation points would likely concern whether the Commonwealth adhered to the Act’s requirements (for example debit limit) or whether written agreements were properly formed and enforced. The Determination itself does not assert or document such cases.
How to discover any litigation connected to these payments
Search federal court records and judgments for cases referencing the Federal Financial Relations Act 2009, the COAG Reform Fund Act 2008, or the specific dates and payment descriptions in Schedule 1. Because the Determination lists particular payment streams, litigation might be connected to those underlying arrangements rather than the Determination per se.
Check public docketing services and decisions databases for claims by or against States that relate to the 21 June 2017 payments, or for parliamentary or administrative review claims contesting the lawfulness of a determination made under s9.
Practical implication for advisers
Absent any recorded litigation in the Determination, do not assume judicial authority has resolved interpretive questions about the Determination’s scope or the interaction between the Act, the COAG Reform Fund Act, the PGPA Act, and the IGA. If contested issues are anticipated, client advisers should prepare to identify relevant written agreements and the IGA provisions, and to examine statutory compliance (for example, whether the debit limit was respected).
Gotchas
This Determination contains several features and cross-references that present practical traps for the unwary adviser or official. These "gotchas" are not evaluative judgments; they are risk points and procedural friction points that arise from the instrument’s drafting and its place in a wider legal architecture.
Exemption from parliamentary disallowance (para 4). The Determination records that subsection 9(5) of the Act makes it a legislative instrument but that section 42 of the Legislative Instruments Act 2003 (disallowance) does not apply. Gotcha: ordinary parliamentary disallowance is not available to challenge or reverse this instrument. Oversight must instead use audit, Estimates, political pressure or legal challenge. Practitioners must not assume the usual disallowance route exists for these determinations.
Broad description of purpose versus requirement for written agreements (paras 5, 8). The Determination describes the assistance as "general purpose financial assistance to be used by the States for any purpose" (para 5). Simultaneously, subsection 7(2) of the COAG Reform Fund Act 2008 requires written agreements specifying terms and conditions for assistance through the Fund (para 8). Gotcha: there is a potential mismatch between the Determination’s broad use language and the requirement for written agreements. Practitioners should not assume funds are entirely unconditional; the written agreement and Schedule D of the IGA may impose conditions or reporting requirements that bind recipients.
Reliance on external documents for essential content (paras 8-11; Schedule 1). The Determination delegates the substantive terms and conditions and many operational details to the IGA (Schedule D) and to written agreements. Gotcha: the Determination does not contain the full legal terms; to understand obligations, conditions and recourse you must obtain and read the IGA Schedule D and the written agreements. Relying only on the Determination text can miss critical contractual terms.
Numeric content reproduced as images (Tables and Schedule 2). The Determination places the payment tables and Schedule 2 as embedded images. Gotcha: automated text searches or machine-readable extraction may miss amounts or recipients if a user relies on text-only search. Practitioners should consult the original instrument with images or the Federal Register of Legislation record to obtain the precise numeric figures and recipient identifications in Table 1 and Table 2.
Debit limit must be monitored (paras 12-14). The Determination reproduces a $5,000,000,000.00 debit limit for the financial year under subsection 9(3) (para 12) and records cumulative totals (para 13-14). Gotcha: procedural failure to check cumulative determinations could result in exceeding the legal debit limit. Commonwealth officials must aggregate determinations across the year to ensure compliance.
Payment timing and accounting sequencing (paras 6, 10). The Determination requires amounts to be credited to the COAG Reform Fund before being paid on 21 June 2017 (paras 6, 10). Gotcha: administrative sequencing matters. Agencies must ensure the crediting operation to the Special Account occurs prior to disbursement, consistent with statutory directions and PGPA account rules.
Interplay with sector-specific arrangements (Schedule 1). Schedule 1 identifies payment streams that derive from other statutory or contractual regimes (for example Snowy Hydro Tax Compensation Deed; Offshore Petroleum royalty arrangements). Gotcha: legal claims or obligations in those other instruments may affect the Commonwealth’s obligations or the State recipients’ entitlements. Practitioners must examine the underlying deeds and statutory provisions where relevant.
No penalties or enforcement mechanisms in the Determination (Penalties and enforcement section above). Gotcha: absence of internal sanctions means enforcement strategies will be negotiated or sourced from the written agreements, the IGA, the COAG Reform Fund Act, or the PGPA Act. States should not assume the Determination provides enforcement certainty; Commonwealth officials should ensure contractual remedies are documented if they seek specific enforceability.
Repetition and duplication in the instrument text. The Determination reproduces some sections multiple times, which could cause confusion about authoritative text if different versions appear online. Gotcha: rely on the Federal Register of Legislation consolidated record to identify the authoritative version.
Special Account rules apply. Because the COAG Reform Fund is a Special Account under the PGPA Act (para 7), agencies must apply PGPA accounting and reporting standards. Gotcha: some program managers unfamiliar with Special Account procedures may fail to meet PGPA reporting and appropriation compliance obligations, which could lead to operational issues or audit findings.
In practice, the following steps reduce these risks: obtain the IGA Schedule D and any written agreements; confirm precise Table 1/2 figures from the official instrument record; ensure account crediting precedes disbursement per the Determination; monitor the cumulative debit limit across determinations for the year; and ensure PGPA Special Account reporting and audit procedures are in place.
How to comply
Compliance under this Determination splits into obligations for Commonwealth officials (those making and implementing the determination and operating the COAG Reform Fund) and for State recipients (which receive and use the funds under the written agreement and the IGA). Below is a practical checklist grounded in the Determination text and the legal instruments it references.
For Commonwealth officials (Treasury, Finance, agencies administering the COAG Reform Fund)
Confirm authority and instrument details.
Ensure the determination is properly recorded and dated as made under section 9 of the Federal Financial Relations Act 2009 (paras 5, 10).
Retain the signed instrument (Assistant Minister Michael Sukkar, dated 19 June 2017) and ensure the Federal Register of Legislation entry is current.
Credit funds to the COAG Reform Fund before disbursement.
Subsection 9(2) requires amounts determined under s9(1) to be credited to the COAG Reform Fund (para 6). Operationally, establish a transaction that credits the Fund prior to making the 21 June 2017 payments.
Observe Special Account and PGPA Act requirements.
Treat the COAG Reform Fund as a Special Account for PGPA Act 2013 purposes (para 7). Apply PGPA account management rules, maintain ledger entries, and prepare the required reporting and audit files.
Verify aggregate debit limit compliance.
S9(3) of the Act establishes an annual debit limit; the Determination records $5,000,000,000.00 for 2016-17 (para 12). Verify that Table 2 cumulative amounts (paras 13-14) keep total determined amounts within that limit. Maintain a running total across the financial year for all determinations affecting the debit limit.
Ensure written agreements are prepared and executed.
Subsection 7(2) of the COAG Reform Fund Act 2008 requires terms and conditions to be in a written agreement between Commonwealth and each State (para 8). Draft and finalise these written agreements, aligning them with Schedule D of the IGA where relevant.
Coordinate payment timing and accounting operations.
Make the actual payments on the date specified by the Determination: 21 June 2017 (para 10 and Table 1 context). Confirm that the crediting to the Fund has been correctly recorded first.
Maintain audit trail, especially for images/tables.
Because Table 1 and Table 2 and Schedule 2 are embedded as images, preserve the original instrument images in the financial records and ensure the numeric values are transcribed into official accounting systems correctly.
Communicate conditions to State recipients.
Provide each State with the written agreement containing the terms and conditions that apply, and advise that the Determination empowers payments but that written agreements and Schedule D govern conditions.
For State governments (recipient entities)
Obtain and review the written agreement.
The Determination makes clear that the terms and conditions for assistance through the COAG Reform Fund are to be contained in a written agreement per subsection 7(2) of the COAG Reform Fund Act 2008 (para 8). Do not assume unconditional treatment simply because funds are described as "general purpose." Negotiate and accept the written agreement, and ensure its terms are acceptable.
Verify payment amounts and receipt.
Check the amounts and payment date as set out in Table 1 and Schedule 2 (para 10 and Schedule 2). Because the tables are images in the Determination, confirm the amounts with the Commonwealth’s finance contact and your internal accounting entries.
Prepare internal accounting and public finance entries.
Record the grants in your budget and accounts as general purpose receipts and ensure use-of-funds controls are consistent with the State’s own budgeting and statutory requirements.
Monitor any condition precedent or reporting obligations.
Even though the Determination states funds can be used by the States for any purpose (para 5), the written agreement or IGA Schedule D may impose reporting or other obligations. Implement systems to meet any reporting or acquittal requirements set out in the written agreement.
Plan for use and audit.
As general purpose funds, they can be allocated across State programs; nevertheless, anticipate audit scrutiny and maintain documentation of decisions and transactions funded by the grant, because the PGPA Act special account regime and the written agreements may require auditable records.
Understand dispute and enforcement mechanisms.
If the written agreement imposes conditions, be clear on the consequences of breach, remedies available to the Commonwealth, and any dispute resolution mechanisms included in the agreement or in the IGA.
Cross-cutting compliance items and pragmatics
Do not rely on parliamentary disallowance as a compliance or oversight mechanism. The Determination explicitly records that section 42 disallowance does not apply (para 4). Instead, expect audit, Estimates and negotiated dispute resolution to be the main oversight avenues.
Check the IGA Schedule D. The Determination specifically points to Schedule D of the Intergovernmental Agreement as setting out payment arrangements (para 9). Practitioners should obtain and read Schedule D to understand payment triggers, timing, and any standard conditions that pertain to general purpose assistance.
Coordinate between Commonwealth finance officers and agency program officers. The Determination is an administrative instrument that interfaces between policy officers who may identify payment needs and finance officers who must effect crediting to the COAG Reform Fund and ensure PGPA compliance.
Preserve the documentary chain. Because the Determination relies on images for numeric tables and includes summaries of other texts (Schedule 1 summarising IGA items), keep original instrument pages, signed written agreements, and all supporting transmittals in one compliance folder to avoid disputes about amounts, dates, or terms later.
By following these steps, Commonwealth and State actors align operational practice with the legal mechanics the Determination establishes: crediting defined amounts to the COAG Reform Fund, ensuring payments are made on the stated date, and implementing or adhering to the written agreements and IGA payment arrangements that govern the terms of use and any reporting obligations.
