What it does
This instrument, the Federal Financial Relations (General Purpose Financial Assistance) Determination No. 132 (February 2020), is a short, ad hoc funding determination made under subsection 9(1) of the Federal Financial Relations Act 2009. The document is signed by Michael Sukkar, Minister for Housing and Assistant Treasurer, and dated 20 February 2020. Paragraph 2 states the determination "commences on the day on which it is made." Paragraph 3 states the core operative action: "The amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States." The table gives a payment date explicit in its title, being "General purpose financial assistance for payment on 21 February 2020."
Mechanically the determination does two things. First, it exercises the delegated or statutory power in sub‑section 9(1) of the Federal Financial Relations Act 2009 to specify amounts of general purpose financial assistance to states. The instrument itself supplies the specific dollar amounts, the recipients (identified by State or Territory name), and the payment timing. Second, by commencing immediately on the day it is made (20 February 2020) it becomes effective to require the payment identified for the next day, 21 February 2020, at least as to the instrument’s stated intent.
The payment schedule in the table shows monetary transfers for three jurisdictions only: Western Australia ($77,634,297.37), the Australian Capital Territory ($3,389,761.64), and the Northern Territory ($432,087.09). The other jurisdictions in the table are recorded with a dash. The table also calculates a "Total" of $81,456,146.10. The instrument therefore creates an entitlement in those three jurisdictions to receive the named sums and creates a corresponding instruction or expectation that the Commonwealth will make those payments as general purpose financial assistance on the stated payment date. The determination contains no express conditions on use of the funds, no schedule of further steps, and no stated penalties or enforcement mechanisms.
