What it does
This instrument, titled Federal Financial Relations (General Purpose Financial Assistance) Determination No. 131 (January 2020), is a ministerial determination made under subsection 9(1) of the Federal Financial Relations Act 2009, as stated in the opening paragraph. It operates as a payment instruction from the Commonwealth to the States, specifying amounts to be paid to deliver “a grant of general purpose financial assistance” to those jurisdictions. Clause 2 sets the commencement rule: the determination commences on the day it is made. Clause 3 states the operative effect: “The amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States.”
Mechanically, the determination performs three discrete functions in the document: (1) identification of the statutory power invoked (s 9(1) of the Federal Financial Relations Act 2009), (2) a commencement provision (cl 2), and (3) an express direction to pay specific amounts to specified jurisdictions on the date shown in the table header (payment on 21 January 2020). The tabular schedule is the operative schedule specifying recipient jurisdictions and dollar values. The table lists amounts for New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, the Australian Capital Territory, and the Northern Territory. Of those, Western Australia is listed as receiving $67,849,463.19, the Australian Capital Territory is listed as receiving $3,389,761.64, and the other jurisdictions are recorded as “-”, with the total of the table stated as $71,239,224.83.
The determination is signed by Michael Sukkar, Minister for Housing and Assistant Treasurer, and dated 15 January 2020. The table heading identifies the scheduled payment date explicitly as “payment on 21 January 2020.” The instrument therefore both creates a legal authorisation under the cited Act and specifies immediate payment amounts and a concrete payment date. It does not, within its four short clauses and schedule, attach conditions to the grants beyond the general purpose described in clause 3, nor does it provide procedural detail about the mechanics of payment, account details, reporting or audit. The determination is limited in scope to the allocation and quantum of the specified general purpose financial assistance on the stated payment date.
