What it does
This instrument, titled Federal Financial Relations (General Purpose Financial Assistance) Determination No. 129 (November 2019), is a payment determination made by the Minister for Housing and Assistant Treasurer, Michael Sukkar, under subsection 9(1) of the Federal Financial Relations Act 2009. The instrument states its commencement is the day it is made, being dated 18 November 2019. Clause 3 records the operative effect: "The amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States." The document then reproduces a single-table schedule headed "General purpose financial assistance for payment on 21 November 2019" that lists specified monetary amounts by State or Territory.
Mechanically, the Determination does three things. First, it identifies the statutory power used to authorise the instrument: subsection 9(1) of the Federal Financial Relations Act 2009. Second, it fixes the date on which the instrument takes effect, namely the day on which it was made (18 November 2019). Third, it sets out precise amounts to be paid to particular jurisdictions as general purpose financial assistance, and it specifies the payment date for those amounts as 21 November 2019. The table in the Determination records payments only to Western Australia, $28,847,337.96, and to the Australian Capital Territory, $3,389,761.64, producing a total of $32,237,099.60. For all other listed States and Territories the table displays a dash, which in the instrument functions as the blank or nil entry for that payment line.
The Determination is an executive authorisation to make and schedule payments for the purpose stated. It does not, in its text, specify conditions attached to the use of the funds beyond the statement of purpose "for the purpose of making a grant of general purpose financial assistance to those States." It does not create statutory duties for State governments in the text, nor does it specify appropriation or accounting arrangements in the instrument itself. The legal basis referenced is s 9(1) of the Federal Financial Relations Act 2009, as expressly acknowledged in the ministerial heading.
