What it does
This instrument is a Commonwealth determination under the Federal Financial Relations Act 2009 that specifies one-off payment amounts to States and Territories described as "for the purpose of making a grant of general purpose financial assistance to those States" (see the Determination text, clause 3). The instrument is titled Federal Financial Relations (General Purpose Financial Assistance) Determination No. 120 (February 2019), and is dated 19 February 2019 (signed by Assistant Minister Zed Seselja), with commencement on the day it was made (clause 2). The preamble records that the determination is made under subsection 9(1) of the Federal Financial Relations Act 2009 (preamble).
Mechanically, the determination does three things: it (1) identifies the statutory power relied on (subsection 9(1) of the Federal Financial Relations Act 2009); (2) declares the determination will commence immediately; and (3) sets out a table of amounts to be paid on 21 February 2019 (the table caption) to particular States and Territories for the stated purpose of general purpose financial assistance (clause 3 and the table headed "General purpose financial assistance for payment on 21 February 2019"). The table lists monetary amounts in dollar-and-cent precision for Western Australia ($93,241,224.73), the Australian Capital Territory ($3,342,960.20), and the Northern Territory ($475,741.76), with hyphens shown for New South Wales, Victoria, Queensland, South Australia and Tasmania, and a total of $97,059,926.69.
The determination contains no operative conditions attaching to the payments beyond the stated purpose of "making a grant of general purpose financial assistance." It does not prescribe uses, reporting requirements, clawbacks, offsets, or enforceable conditions in the text of the instrument. Nor does it include penalties, compliance processes or administrative directions about how agencies must make, receive or account for the payments; those matters, if relevant, are handled elsewhere or by administrative practice. The instrument repeats the name and commencement entries, indicating the formalisation of the subordinate instrument and its immediate effect.
