What it does
This instrument, titled the Federal Financial Relations (General Purpose Financial Assistance) Determination No. 115 (September 2018), is a short statutory determination made under subsection 9(1) of the Federal Financial Relations Act 2009. The determination is dated 19 September 2018 and, by its own clause 2, commences on the day on which it is made. Clause 3 sets out the operative effect: the amounts specified in the attached table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States. The table, headed “General purpose financial assistance for payment on 21 September 2018”, lists receipt lines for each State and Territory. For this particular payment the table records monetary amounts only for Western Australia ($87,316,690.68) and the Australian Capital Territory ($3,342,960.20). All other jurisdictions in the table , New South Wales, Victoria, Queensland, South Australia, Tasmania and the Northern Territory , are recorded with a dash in the amount column, indicating no payment specified for them in this determination. The table also shows a total sum of $90,659,650.88, which equals the arithmetic sum of the two recorded amounts.
Mechanically, the determination: (a) invokes the statutory power identified in the heading (subsection 9(1) of the Federal Financial Relations Act 2009), (b) fixes a commencement date as the date of making (cl 2), (c) identifies the object of the payment as “for the purpose of making a grant of general purpose financial assistance to those States” (cl 3), and (d) specifies the payment amounts and the scheduled payment date of 21 September 2018 in the embedded table. The instrument does not include further conditions, reporting obligations, payment instructions, or enforcement provisions; it is a single-purpose payment specification. The instrument is signed and dated by Zed Seselja, identified in the instrument as Assistant Minister for Treasury and Finance.
