What it does
This instrument, the Federal Financial Relations (General Purpose Financial Assistance) Determination No. 113 (July 2018), is a Treasurer’s determination made under subsection 9(1) of the Federal Financial Relations Act 2009. The document is signed by Scott John Morrison and dated 19 July 2018 (see the heading and signature block). Clause 2 states the determination commences on the day it is made. Clause 3 prescribes that the amounts in the attached table "are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States."
Mechanically the Determination does three things, set out in the expressed text:
- It identifies the statutory source of authority for the instrument, namely subsection 9(1) of the Federal Financial Relations Act 2009 (as stated in the opening paragraph).
- It sets its commencement date as the day it is made (clause 2).
- It specifies, via a table headed "General purpose financial assistance for payment on 23 July 2018", the exact monetary amounts to be paid to named jurisdictions for the purpose of making grants of general purpose financial assistance (clause 3 and the table).
The payment table lists amounts for each State and Territory. Two jurisdictions are allocated positive amounts: Western Australia $57,751,741.33 and the Australian Capital Territory $3,342,960.20. The other jurisdictions are shown with a dash, which in the table context indicates no payment is specified for those jurisdictions for this payment event. The table also records a total of $61,094,701.53, which equals the sum of the two positive amounts.
The Determination is narrowly framed and focussed on a single payment round dated for payment on 23 July 2018. It does not purport to set conditions on how the receiving States must use the funds within the Determination text. It also does not specify administrative payment mechanics, appropriation authorities, or penalties. The legal provenance and the schedule of amounts are the instrument’s operative content.
