What it does
This instrument is a Treasurer’s determination made under subsection 9(1) of the Federal Financial Relations Act 2009 (the Act). The front page records the maker as Scott John Morrison, Treasurer, and the instrument is titled Federal Financial Relations (General Purpose Financial Assistance) Determination No.112 (29 June 2018). The instrument states it “commences on the day on which it is made” (Commencement, para 2). The operative content is a single payment schedule: paragraph 3 directs that the amounts set out in the table are “to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States.” The table identifies that the payments are for “payment on 29 June 2018.”
Mechanically, the determination does four things and no more: it identifies the legal source of authority (subsection 9(1) of the Act), it identifies the maker (the Treasurer), it fixes the time of commencement (immediate on the day it is made), and it specifies monetary amounts to be paid to named jurisdictions for a stated purpose (general purpose financial assistance). The table is the only place where amounts are specified: New South Wales $44,364,723.00; Victoria $22,182,361.35; Northern Territory $259,600,000.00; and a Total of $326,147,084.35. Queensland, Western Australia, South Australia, Tasmania and the Australian Capital Territory are shown with a hyphen in the amount column.
The instrument does not include conditions attached to the payments, procedural directions for how the payments are to be administered, an appropriation reference or a specific Commonwealth account to be debited, nor does it specify follow-up reporting or clawback arrangements. The text repeats the Name of determination and Commencement headings, and reproduces the same payment table more than once. The signature block records the Treasurer’s name and a date of 26 June 2018 but the title and table header indicate payment on 29 June 2018; the instrument’s commencement clause treats the making date as the operative commencement point (Commencement, para 2). The payment schedule and its total reconcile arithmetically: the three numeric entries sum to the listed total ($44,364,723.00 + $22,182,361.35 + $259,600,000.00 = $326,147,084.35), matching the table total.
This determination is therefore a limited, time-specific allocation instrument that directs particular cash amounts to be paid to the States for the stated purpose of making general purpose financial assistance grants on or for the payment date shown.
