What it does
This instrument, titled Federal Financial Relations (General Purpose Financial Assistance) Determination No. 111 (June 2018), is a Commonwealth legislative instrument made under subsection 9(1) of the Federal Financial Relations Act 2009. The determination is dated 18 June 2018 and signed by the Assistant Minister to the Treasurer, Michael Sven Sukkar. It commences on the day it was made (see clause 2) and operates to specify precise payment amounts that are to be paid to particular jurisdictions on a single payment date.
Mechanically, the instrument performs three discrete functions. First, it names itself (clause 1). Second, it declares its commencement rule: it commences on the day on which it is made (clause 2). Third, it effects a payment schedule: clause 3 states, in plain terms, that “The amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States.” That clause is followed by a table titled “General purpose financial assistance for payment on 21 June 2018”, which lists jurisdictions and monetary amounts in Australian dollars.
The table, read with clause 3, fixes the following cash flows on 21 June 2018: Western Australia, $77,080,810.86; Australian Capital Territory, $3,296,804.93; all other listed jurisdictions (New South Wales, Victoria, Queensland, South Australia, Tasmania, Northern Territory) are shown with a hyphen, which in context of the table represents no payable amount. The table also includes an arithmetic total of $80,377,615.79. The instrument contains no scheduling conditions, allocation formulas, or ancillary administrative detail beyond the date, the list of jurisdictions, the numerical amounts, the total, and the statement of purpose quoted above. The Determination repeats its title and the same clauses twice in the document, but both iterations are identical in substance.
