What it does
This Instrument is a short, specific spending determination made under the Federal Financial Relations Act 2009. It (1) records the Assistant Minister to the Treasurer exercising the power in subsection 9(1) of the Federal Financial Relations Act 2009 to make a determination, (2) commences immediately on the day it is made, and (3) directs payment of specified sums to States for the stated purpose of "making a grant of general purpose financial assistance to those States" (see the instrument preamble and paragraphs 1-3). The determination includes a table labelled "General purpose financial assistance for payment on 21 May 2018" that identifies the payment date and sets out the recipient States and monetary amounts. The table lists two positive payment entries: Western Australia $66,064,287.47 and the Australian Capital Territory $3,296,804.93, and a total of $69,361,092.40; other States are shown with a hyphen in the amount column (the table is the operative statement of amounts).
Mechanically, the instrument does three narrow things. First, it invokes the statutory power in s 9(1) of the Federal Financial Relations Act 2009, by the Assistant Minister to the Treasurer, to make a determination. The instrument records that the determination is made on 17 May 2018 and commences on the day it is made (paragraph 2). Second, it specifies that the Commonwealth is to pay the amounts specified in the attached table "to the States for the purpose of making a grant of general purpose financial assistance to those States" (paragraph 3). Third, it lists the amounts and a payment date: the table caption expressly states the payment is for 21 May 2018.
The document is procedural rather than programmatic: it does not attach conditions to the payments in the text provided, it does not create reporting obligations, and it does not amend any underlying policy framework. The determination is limited to specifying amounts and the payment date and, by implication, authorising the Commonwealth to disburse those amounts on the stated date. The signature block shows that the Assistant Minister to the Treasurer, Michael Sven Sukkar, signed and dated the determination on 17 May 2018.
