What it does
This instrument, the Federal Financial Relations (General Purpose Financial Assistance) Determination No.108 (March 2018), is a one-off administrative determination that specifies fixed cash amounts the Commonwealth is to pay to particular States and Territories for the ostensible purpose of making a grant of general purpose financial assistance (GPFA) to those jurisdictions. The instrument is expressed as being made under subsection 9(1) of the Federal Financial Relations Act 2009; the covering paragraph records the maker as Michael Sven Sukkar, Assistant Minister to the Treasurer, and is dated 16 March 2018. Clause 1 gives the instrument its name, clause 2 provides that the determination "commences on the day on which it is made", and clause 3 states the operative command: "The amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States."
Mechanically, the determination does three discrete things. First, it identifies the legal power under which it is made (subsection 9(1) of the Federal Financial Relations Act 2009). Second, it sets an immediate commencement date (the day made). Third, it specifies the precise monetary amounts, and a payment date, in a single table headed "General purpose financial assistance for payment on 21 March 2018." The table lists individual States and Territories and an amount next to each. Two entries contain positive amounts: Western Australia, $59,131,301.52; Australian Capital Territory, $3,296,804.93. All other listed jurisdictions show a dash (hyphen) in the amount column, which in the published instrument functions as a nil entry. The table also records a Total: $62,428,106.45.
The instrument contains no further operative conditions, reporting requirements, restrictions on use beyond the stated purpose, nor any schedule of allocation methodology. It does not itself contain an appropriation clause, nor does it specify any monitoring, review, penalties, or enforcement mechanisms. It is thus a narrowly-focused determination: an authorising and descriptive device that fixes amounts and a payment date under the statutory power it cites.
