What it does
This instrument is a single-sitting Commonwealth determination that directs specified cash transfers to the States and Territories for a single payment date. The document is titled Federal Financial Relations (General Purpose Financial Assistance) Determination No. 107 (February 2018) and is expressed to be made by the Assistant Minister to the Treasurer, Michael Sven Sukkar, under subsection 9(1) of the Federal Financial Relations Act 2009 (the Act). The determination commences on the day it is made, per clause 2. Its operative provision, clause 3, states that "the amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States." The table is labelled as applying to payment on 21 February 2018.
Mechanically, the Determination: (a) establishes the legal authority for the Commonwealth to pay a discrete set of amounts to the States and Territories on a specified payment date; (b) provides the recipient list and quantum per recipient in the table; and (c) records the maker, date of signature (15 February 2018) and the statutory head of power relied upon (subsection 9(1) of the Federal Financial Relations Act 2009). The table discloses amounts only for Western Australia ($65,002,420.02), the Australian Capital Territory ($3,296,804.93) and the Northern Territory ($705,188.73), with other jurisdictions shown with a dash in the amount column. The total payable is recorded as $69,004,413.68.
The document is limited in scope. It does not set ongoing entitlements, conditions on state use of funds, reporting requirements, timing other than the single payment date, nor administrative processes for delivery beyond the instruction that the specified amounts "are to be paid." The instrument therefore performs a narrow fiscal function: it exercises the statutory power to allocate a one-off tranche of general purpose financial assistance to particular jurisdictions and records the aggregate total of those allocations.
