What it does
This instrument is a ministerial determination under subsection 9(1) of the Federal Financial Relations Act 2009. It directs the Commonwealth to make specified payments to States, with the declared purpose that those payments be used by the States as general purpose financial assistance. The determination (titled Federal Financial Relations (General Purpose Financial Assistance) Determination No. 102 (September 2017)) was signed by Michael Sven Sukkar, Assistant Minister to the Treasurer and dated 15 September 2017. The determination contains an express commencement clause: it "commences on the day on which it is made" (clause 2). Clause 3 states the operative instruction: "The amounts specified in the following table are to be paid to the States for the purpose of making a grant of general purpose financial assistance to those States."
Mechanically, the document performs three actions: (1) it establishes itself as a determination under s 9(1) of the Federal Financial Relations Act 2009; (2) it fixes a payment schedule and amounts in a table headed "General purpose financial assistance for payment on 21 September 2017"; and (3) it identifies recipient States and precise monetary amounts (to the cent) to be paid on that specified payment date. The table lists payments only to Western Australia ($56,003,702.87) and the Australian Capital Territory ($3,296,804.93) and records hyphens for the other jurisdictions (New South Wales, Victoria, Queensland, South Australia, Tasmania and Northern Territory). The total specified is $59,300,507.80, which equals the arithmetical sum of the two non-hyphen entries.
The determination does not include conditions on how the States must use the funds beyond the stated object "making a grant of general purpose financial assistance". The instrument repeats its title, commencement and operative determination language in duplicated blocks; the operative content and the table appear multiple times in the text. The payment date in the table is explicit: 21 September 2017. The date the determination was made, recorded on the instrument, is 15 September 2017; given clause 2, the instrument legally commenced on that day. The determination is therefore a short, discrete authorisation to distribute a specific amount of Commonwealth money to two jurisdictions on a specified payment date for general purpose use.
