What it does
This instrument, titled the Federal Financial Relations (General Purpose Financial Assistance,2021‑22 Payment No. 2) Determination 2021, records a formal determination of specified dollar amounts to be paid to named States and Territories for the purpose of making a grant of general purpose financial assistance (s 1; s 5). The instrument is expressly made under the Federal Financial Relations Act 2009 (s 3), and the determination in Part 2 is identified as being made under subsection 9(1) of that Act (Note 1 to Part 2). The instrument therefore operates as a quantitative allocation: it specifies, in a single table in section 5, the nominal amounts that will be paid to particular States and Territories.
Mechanically the determination (s 5) lists nine items: amounts for New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, Australian Capital Territory, Northern Territory, and a Total. The table in s 5 records monetary figures. Five jurisdictions,New South Wales, Victoria, Queensland, South Australia and Tasmania, are shown with the notation “$-” in the Determined amount column. Western Australia is shown with $2,158,565,459.18, the Australian Capital Territory with $3,475,027.71 and the Northern Territory with $612,235.89. The Total is shown as $2,162,652,722.78; arithmetically the Total equals the sum of the Western Australia, Australian Capital Territory and Northern Territory entries (2,158,565,459.18 + 3,475,027.71 + 612,235.89 = 2,162,652,722.78), which indicates the “$-” entries operate as nil allocations in this table as presented.
The instrument sets its commencement mechanics in s 2. Section 2(1) reproduces a commencement table and states that “The whole of this instrument” commences “The day this instrument is registered.” The table also carries a formal note that column 3 material is not part of the instrument and may be edited in published versions (s 2(2)). A second administrative note to Part 2 records that the payments are proposed to be made in August 2021 (Note 2 to Part 2). The instrument contains a definitions provision that cross‑links to the Federal Financial Relations Act 2009 and to the operation of the Legislation Act 2003 on meaning (s 4).
