What it does
This instrument , the Federal Financial Relations (General Purpose Financial Assistance,2020-21 Payment No. 7) Determination 2021 (the instrument) , records a determination of amounts said to be payable as general purpose financial assistance to certain States and Territories. The instrument identifies specific dollar amounts for two jurisdictions (Western Australia and the Australian Capital Territory) and lists $- for the other States and the Northern Territory; the table also gives a total of $40,025,421.10 (see s 5 and the table in s 5).
The instrument is made under the Federal Financial Relations Act 2009 (the Act), expressly stated in s 3. A note in Part 2 records that the determinations in that Part are made under subsection 9(1) of the Act and that a payment of the amounts determined is proposed to be made in January 2021 (Part 2 notes, immediately preceding s 5). The instrument’s commencement rule is that the whole instrument commences, or is taken to have commenced, on the day the instrument is registered (s 2 and the commencement table). The commencement table contains a column 3 that the instrument says is not part of the instrument and that information in that column may be edited or inserted in any published version (s 2(2) and the commencement table note).
Mechanically, the legal effect created on registration is the specification of determined amounts "to be paid to the State mentioned in that item for the purpose of making a grant of general purpose financial assistance to that State" (s 5). The table in s 5 is therefore the operative schedule of entitlements or determinations, and the instrument name and sections supplied are the formal legal vehicle that records the Commonwealth’s (or the statutory authority’s) decision to specify these amounts under the Act. The instrument contains no text in itself that describes payment mechanics, administrative procedures for claiming or distributing the amounts, penalties for non‑payment, or conditions attached to the amounts; those elements, if any, are left to be located in the Act or in administrative processes outside this instrument.
