#### 58FA Offence for failing to appear before the Court (1) A person commits an offence if: (a) the person is the accused; and (b) the person gives the Court a bail undertaking; and (c) the person is released on bail under this Part; and (d) the person fails to appear before the Court in accordance with the bail undertaking. Penalty: Imprisonment for 2 years. > Note: The accused’s bail will also be reconsidered under Division 3. (2) Subsection (1) does not apply if the person has a reasonable excuse. > Note: A defendant bears an evidential burden in relation to the matter in subsection (2)—see subsection 13.3(3) of the Criminal Code.
