8Federal Circuit Court of Australia

#### 8 Federal Circuit Court of Australia (1) The federal court known immediately before the commencement day as the Federal Magistrates Court is continued in existence as the Federal Circuit Court of Australia. (3) The Federal Circuit Court of Australia is a court of record and is a court of law and equity. (4) The Federal Circuit Court of Australia consists of the following: (a) a Chief Judge; (b) such other Judges as from time to time hold office in accordance with this Act. (5) The person holding office as the Chief Federal Magistrate under this Act immediately before the commencement day continues to hold that office under the title of Chief Judge of the Federal Circuit Court of Australia. (6) A person holding office as a Federal Magistrate (other than Chief Federal Magistrate) under this Act immediately before the commencement day continues to hold that office under the title of Judge of the Federal Circuit Court of Australia. > Note: The Parliament may create federal courts under Chapter III of the Constitution.
