##### 40 Minister may vary corporate plan (1) Without limiting the generality of the Minister’s powers under subsection 41(1A) or (2), the Minister may direct the Board to vary the Corporation’s corporate plan in respect of financial targets or non‑financial performance measures or both. (2) When exercising his or her powers under subsection (1), the Minister shall have regard to: (a) the matters specified in paragraphs 39(1)(a), (b), (c), (d), (e), (ea) and (f); and (b) such other commercial considerations as the Minister thinks fit. (3) Where the Minister has given the Board: (a) a direction under subsection (1); and (b) the reasons for the direction; the Board shall comply with the direction.
