What it does
This Act creates, vests and regulates a memorial research fund referred to as the Farrer Memorial Research Scholarship Fund (the fund). It defines the fund by reference to specific moneys and investments formerly held by named individuals and offices and specifies that those moneys, together with their investments and accrued interest, are vested in trustees appointed under the Act, to be invested in securities authorised by the Trustee Act 1925 (s 2; s 6(1)). The Act prescribes the composition of the trusteeship, combining named non‑official trustees (historical names and their successors) and a set of ex officio or nominated official trustees (Dean of the Faculty of Agriculture of the University of Sydney; the Secretary of the Department of Regional NSW or the Secretary’s nominee; a Deputy Secretary of the Department nominated by the Secretary; and an officer of the Commonwealth Scientific and Industrial Research Organisation nominated by the Minister) (s 3). It sets a quorum of three and provides that trustees may act by a majority of those present (s 4).
Income rules and permitted uses are central. The Act requires the trustees to invest the fund in securities authorised by the Trustee Act 1925 (s 6(1)). It then requires that the interest arising from those investments be expended, in amounts determined from time to time by the trustees, for two specified purposes: (a) enabling any person selected by the trustees to carry out study or research in agricultural problems, and (b) at the trustees’ discretion, meeting the whole or part of costs of an annual Farrer Memorial Oration and the annual presentation of the Farrer Memorial Medal and paying an honourarium to the medal recipient (s 6(2)(a)-(b)). The trustees have express power to set the nature of acceptable investigations, select persons with the necessary qualifications, appoint those persons as Farrer Memorial Research Scholars for whatever period the trustees determine, and to revoke appointments after inquiry where the trustees are satisfied the holder’s conduct or work is such that they should no longer retain the scholarship (s 7).
