Farm Household Support (Forced Disposal of Livestock) Minister’s Rules 2019

The instrument pivots on a small set of legal concepts whose precise definitions and cross‑references determine entitlement to the non‑income treatment.

• Forced disposal of livestock. The Schedule inserts a new definition that covers disposal, including killing, of livestock or portions of carcasses by an entity within the meaning of the Income Tax Assessment Act 1997. The definition is causal: the disposal must occur wholly or mainly for one or more of four enumerated reasons: (a) an action by the Commonwealth, a State, a Territory or an authority that means the land or water cannot be used commercially to support the livestock, other than with the entity’s free consent (the instrument gives compulsory acquisition and changes of law by way of example); (b) drought or natural disaster affecting pasture, fodder or water so the entity could not reasonably support the livestock; (c) reasonable concern for the welfare of the livestock; and (d) a requirement by or under a law of the Commonwealth, a State or a Territory to dispose of the livestock (Schedule 1, item 1, definition of forced disposal of livestock).

• Farm management deposit owned by a person. The instrument imports the term "farm management deposit" by reference to the Income Tax Assessment Act 1997 and defines "owned by a person" to mean a farm management deposit of which the person is the owner within the meaning of that Act (Schedule 1, item 1). The instrument therefore depends on the tax law definition and ownership rules to determine whether a deposit qualifies.

• Attribution and membership interest. The Schedule recognises situations where a receipt is attributable to a forced disposal carried out by an entity in which a person holds a membership interest, directly or through interposed entities (Schedule 1, item 2, paragraphs (cc) and (cd)). Those cross‑references again import tax law definitions of entity and membership interest from the Income Tax Assessment Act 1997.

• Non‑income items and temporary non‑income. The Schedule adds amounts received because of forced disposals that are deposited as farm management deposits to the list of amounts that are not income under subsection 8(8) of the Social Security Act 1991 (paragraphs (ca) and (cc)). It also creates a mechanism for temporarily treating an amount as not income where the recipient has received the amount and informs the Secretary within 42 days that it will be deposited as a farm management deposit, ensuring such notified amounts are not income at any time during that 42‑day period (paragraphs (cb), (cd) and subsection 8(8AAAA)).

Interdependency. The text repeatedly depends on the Income Tax Assessment Act 1997 for key terms and on the Farm Household Support Act 2014 for the instrument’s purpose and authority (ss 3-4; Schedule 1, items 1-3). The social security income test is therefore adjusted only in relation to the Farm Household Support regime, using tax law constructs to determine whether proceeds are treated as a deposit and hence excluded from income.

Temporal scope. The instrument applies only to forced disposals occurring on or after 1 July 2019 (s 5). The commencement table confirms the entire instrument commenced on that date (s 2 and the commencement table).

Primary affected persons and entities include:

• Individuals and natural persons who receive amounts because of a forced disposal of livestock and who are eligible for, or applying for, Farm Household Support payments under the Farm Household Support Act 2014 as informed by the Social Security Act 1991 income rules (Schedule 1, item 2). The Schedule specifically contemplates amounts "received by a person because of forced disposal of livestock by the person" (paragraphs (ca) and (cb)).

• Persons who hold membership interests in entities that carried out the forced disposal. The Schedule addresses amounts attributable to forced disposals by entities in which a person holds a membership interest, either directly or through interposed entities (paragraphs (cc) and (cd)). That captures beneficiaries, partners, members, shareholders or many trust or company investors to the extent the Income Tax Assessment Act 1997 treats them as holding a membership interest.

• Entities that perform the disposal. The definition of forced disposal applies to disposal by an entity within the meaning of the Income Tax Assessment Act 1997 (Schedule 1, item 1). Accordingly, companies, partnerships, trusts or other entities defined under the tax legislation are within the instrument’s scope as disposers whose actions can give rise to receipts that qualify for the rules.

• The Secretary. The instrument requires the recipient to inform the Secretary of the receipt and proposed deposit in the 42‑day window to secure temporary non‑income treatment (paragraphs (cb) and (cd) and subsection 8(8AAAA)). The Secretary therefore becomes an administrative gatekeeper for the notification mechanism.

• Administrators of the farm management deposit regime. Although the instrument does not amend tax law, it expressly conditions the non‑income treatment on depositing amounts as a "farm management deposit" as defined and owned under the Income Tax Assessment Act 1997. Providers or administrators of FMD products and tax authorities responsible for FMD compliance will be indirectly affected to the extent recipients must use FMDs as defined in tax law.

Secondary and indirect effects:

• Departmental compliance resources. The Secretary is required to receive and presumably process notifications under the new paragraphs. The instrument does not specify administrative processes or timeframes beyond the 42‑day limit; resource needs for verification and recordkeeping will fall to the administering department.

• Claimants of Farm Household Support. The change alters the income base used in determining eligibility for Farm Household Support by excluding certain receipts if deposited as specified. That affects assessments and may change whether claimants satisfy means tests.

• Agricultural lenders, accountants and tax advisers. Professional advisers will need to advise clients about whether a compensation receipt for disposal qualifies as a forced disposal and whether it is practical to deposit as an FMD within the 42‑day window.

The instrument does not create new classes of regulated entities or change ownership rules; rather it attaches a social security income consequence to actions that are already governed by tax law definitions and rules (Schedule 1, item 1).

Duties imposed by the instrument are procedural and conditional rather than prescriptive penalties. Principal duties and rights include:

• Duty to deposit or notify to secure non‑income treatment. A person who receives an amount because of a forced disposal secures exclusion from income under the Social Security Act if the amount is deposited as a farm management deposit owned by the person (paragraph 8(8)(ca)). Alternatively, the person can secure temporary non‑income treatment by informing the Secretary within 42 days from receipt that the amount will be deposited as an FMD and that the 42‑day period has not ended (paragraph 8(8)(cb) together with inserted subsection 8(8AAAA)). The same structure applies for amounts attributable to forced disposals by entities in which the person holds a membership interest (paragraphs 8(8)(cc) and (cd) and subsection 8(8AAAA)).

• Right to non‑income treatment on deposit. Paragraphs (ca) and (cc) add deposited amounts to the list of amounts that are not income (the list at subsection 8(8) of the Social Security Act). That is a right conferred by the statutory modification: if the factual conditions in the paragraph are met, the amount is not counted as income under the Social Security Act for the purposes specified in the Farm Household Support Act 2014.

• Administrative duty to inform the Secretary. The person has an affirmative duty to inform the Secretary in the 42‑day window if they intend to deposit the amount as a farm management deposit in order to preserve temporary non‑income status (paragraphs 8(8)(cb) and (cd)). The instrument sets a strict timing boundary: the notification must occur in the 42 days beginning on the day the person received the amount, and the 42‑day period must not have ended (cb(iii), cd(iii)).

• Reliance on tax law ownership and definitions. The right to non‑income treatment is conditional on the deposit being a farm management deposit "owned by the person" within the meaning of the Income Tax Assessment Act 1997 (paragraphs (ca) and (cc)). Likewise, attribution rules for receipts arising from entities turn on tax law concepts such as "entity" and "membership interest" (paragraphs (cc) and (cd)). Persons must therefore ensure their deposits and ownership status align with the tax law definitions to rely on the Social Security Act modification.

• Temporal limitation on the notification safety net. Subsection 8(8AAAA) clarifies that amounts meeting the notification conditions in (cb) or (cd) "are not income at any time in the period described in that paragraph." The instrument therefore creates only a temporary shield for notified receipts pending actual deposit. If the 42‑day period ends without deposit, the instrument does not create a continuing non‑income right under the notification mechanism; the right under (ca)/(cc) depends on actual deposit.

• Interaction with Farm Household Support Act purposes. The entire modification is made for the purposes set out in section 91 of the Farm Household Support Act 2014 and under the authority of subsection 106(1) of that Act. That contextualises the duty and rights as relevant to Farm Household Support rather than general social security law (ss 3 and 4).

The instrument does not set out further procedural requirements for how the Secretary must validate a notice or verify a deposit, nor does it create an obligation on third parties to facilitate the deposit. Those activities will be governed by the administrative practice of the department and by the Income Tax Assessment Act 1997 insofar as FMD rules apply.

The instrument does not create new criminal offences, civil penalties, or express enforcement mechanisms within its own text. It functions as an amendment to the list of non‑income items in the Social Security Act 1991 for the purposes specified by the Farm Household Support Act 2014 (s 4). The Schedule makes no provision for penalties, sanctions, or specific administrative enforcement procedures relating to notifications, false statements, or failure to deposit (Schedule 1, items 2-3).

Consequently:

• No penalties are provided in this instrument itself. The instrument is silent on sanctions for non‑compliance with the notification requirement or on consequences of false statements made to the Secretary under the notification mechanism. Any enforcement action or penalties that might apply for false statements, fraudulent notification or incorrect declarations must therefore be sought in the broader statutory framework applicable to social security administration and to the Farm Household Support Act 2014, or under general legal provisions, none of which are amended or set out in this instrument (s 4).

• Verification and administrative enforcement are left to existing departmental processes. The Secretary is the entity to whom notification must be given (paragraphs 8(8)(cb) and (cd)). The instrument does not prescribe how the Secretary must verify deposit into a farm management deposit or what evidentiary standard is required. Administrative steps that the Secretary may take to verify compliance will thus be matters of departmental procedure and of the intersection with tax‑law administration concerning farm management deposits.

• Timing risk and potential loss of benefit. Because the instrument conditions temporary non‑income treatment on the 42‑day notification window and non‑income treatment on actual deposit as a farm management deposit, failure to meet the notification or deposit conditions could result in the amount being treated as income under the Social Security Act. That exposure is an enforcement risk in the sense of eligibility and means‑test consequences, even though the instrument does not itself identify specific penalty provisions.

Users should therefore be aware that while this instrument creates eligibility‑protecting rules, it does not itself create an enforcement apparatus, nor does it specify penalties for misuse of the notification mechanism. Any enforcement outcome will depend on the application of the Social Security Act 1991 and the Farm Household Support Act 2014 in practice and any relevant administrative rules or offences in those Acts, which are outside the scope of this instrument as drafted (s 4).

The instrument deliberately cross‑references and depends on two other federal laws and the administrative framework of the Farm Household Support Act 2014.

• Income Tax Assessment Act 1997. The Schedule defines "farm management deposit owned by a person" by direct reference to the Income Tax Assessment Act 1997 (Schedule 1, item 1). It also imports the notions of "entity" and "membership interest" from that tax Act when dealing with amounts attributable to forced disposals by entities in which the person holds a membership interest (paragraphs 8(8)(cc) and (cd)). That means the availability and mechanics of the exclusion rely on tax law rules governing what constitutes an FMD, who can own an FMD, ownership through corporate or trust structures, caps, restrictions on deposits and withdrawals, and any other tax law conditions applicable to FMDs. The instrument does not alter tax law; it assumes the reader will apply the ITAA 1997 definitions to determine whether an amount meets the instrument’s conditions.

• Social Security Act 1991. The instrument directly modifies the Social Security Act 1991 by inserting definitions into subsection 8(1) and adding new items to subsection 8(8), the list of amounts that are not income (Schedule 1, items 1-3). The modifications operate for the particular purposes specified by the Farm Household Support Act 2014 (see s 4 of the instrument). Therefore, the instrument interacts with the Social Security Act’s income testing and administrative provisions: amounts excluded under the inserted paragraphs will not count as income for whatever social security purposes the FHSA 2014 directs the SSA 1991 to be used (s 4).

• Farm Household Support Act 2014. The instrument is made under subsection 106(1) of the Farm Household Support Act 2014 and expressly states that the Social Security Act 1991 has effect for the purposes set out in section 91 of the Farm Household Support Act 2014 with the modifications in Schedule 1 (s 3 and s 4). The instrument therefore tailors the Social Security Act to the Farm Household Support regime. The precise policy goals in sections 91 and 92 of the FHSA 2014 are referenced by the instrument as the justification and limit of the modifications, and the instrument’s text should be read as only engaging the Social Security Act where the FHSA 2014 requires it.

• State and Territory laws. The definition of forced disposal includes disposals caused by actions under a law of the Commonwealth, a State or a Territory and by requirements by or under such laws (Schedule 1, item 1). That means State and Territory regulatory actions and compulsory acquisitions can trigger the definition. Conversely, the instrument does not alter or displace State and Territory laws themselves; it only treats resulting payments as potentially non‑income for purposes of the Farm Household Support income rules.

• Administrative law and departmental procedures. The Secretary’s role in receiving notifications is central to the temporary non‑income mechanism. How the Secretary validates notices and decides the effect of deposit or non‑deposit will involve administrative law principles and departmental operational rules, but the instrument itself does not provide procedural detail.

Practical interaction effects:

• If tax law limits the amount that may be held as a farm management deposit or constrains ownership, that tax law will limit how much of a forced‑disposal receipt a person can shelter from income testing by using an FMD. The instrument does not modify tax limits, so any cap, time limitation, or ownership rule in the ITAA 1997 constrains the social security exclusion.

• Attribution complexities under tax law, such as interposed entities or membership interests, are imported into the social security context via paragraphs (cc) and (cd). Determining whether a receipt is "attributable" to a forced disposal by an entity in which the person holds a membership interest will therefore require reference to tax‑law attribution rules.

• The exclusion only covers amounts "received because of forced disposal of livestock." Other payments, compensatory sums, or assistance payments that are not causally connected to a forced disposal will not qualify.

All cross‑references in these interactions are established in the instrument itself (s 4; Schedule 1, items 1-3) and must be applied precisely against the external statutes mentioned.

The instrument records its own commencement and notes about the commencement table but contains no further amendment history in its text.

• Original making and commencement date. The instrument is dated 3 April 2019 and was made by the Minister for Agriculture and Water Resources, David Littleproud (cover page). The commencement table states that "the whole of this instrument" commenced on 1 July 2019; and the application provision confirms it applies to forced disposals occurring on or after that date (ss 2 and 5).

• Authority for the instrument. It is made under subsection 106(1) of the Farm Household Support Act 2014 (s 3). Section 4 records that, for the purposes of section 92 of the Farm Household Support Act 2014, the Social Security Act 1991 has effect with the modifications set out in Schedule 1.

• Publication notes. The commencement table includes a standard note that the table relates only to the provisions of the instrument as originally made and will not be amended to deal with later amendments of this instrument. The instrument contains no later amending provisions in its text and no schedules or notes indicating subsequent variation.

• No subsequent amendments recorded in this instrument. The text as provided does not include any amendments, revocations, replacement rules, or other variations after the original making. If any later instruments amend or repeal this rule, such changes are not recorded in the provided text.

• Relationship to enabling Act. The instrument is limited to the authority provided by the Farm Household Support Act 2014 (s 106(1)) and to the purposes set out in s 91 and s 92 of that Act by reason of s 4 of the instrument. Any amendment to the enabling Act that affects subsection 106(1), or to section 91 or 92, could affect the scope of this instrument, but no such changes are recorded within the instrument itself.

In short, the instrument was made once, commenced 1 July 2019, and the text contains no amendment history or later changes. The provided document makes explicit that the commencement table is limited to the instrument as originally made, which signals the instrument’s original‑text status without later provable amendments in this source.

The instrument itself does not record any litigation history. The text contains no references to judicial decisions, appeals, or administrative review outcomes concerning its operation. The Schedule does not cite cases, and the instrument does not contain a section reporting challenges or determinations under administrative law.

Because the source is the original instrument text, it contains no account of subsequent disputes or litigation between claimants and the department, nor any guidance about precedential decisions. Any litigation that may have occurred after the instrument’s commencement would not appear in this text. Therefore, based solely on this instrument, there is no recorded litigation history to report.

Practitioners seeking to know whether courts or tribunals have interpreted the new paragraphs, the definition of forced disposal, or the operation of the 42‑day notification should consult case law databases and administrative review records external to this instrument. The instrument does not itself provide precedential interpretation or judicial exposition.

This instrument introduces a narrowly tailored mechanism that carries several practical traps that arise from its reliance on tax law terms, timing conditions and attribution rules.

• 42‑day timing constraint. The temporary non‑income protection exists only for amounts for which "in the period of 42 days beginning on the day the person received the amount, the Secretary is informed that the person has received the amount (or a greater amount including the amount) and that the amount will be deposited as a farm management deposit owned by the person" and only while that period has not ended (paragraphs 8(8)(cb) and (cd); subsection 8(8AAAA)). If a recipient fails to notify the Secretary within that 42 days, the temporary shield is unavailable. The instrument does not specify a grace period, delayed notification procedure, or appeal right for missed notifications.

• Deposit requirement pinned to tax law ownership. Non‑income treatment that depends on deposit requires the amount to be deposited as a farm management deposit "owned by the person" as defined in the Income Tax Assessment Act 1997 (paragraphs 8(8)(ca) and (cc)). If tax law rules prevent deposit of the whole amount into an FMD (for example due to caps, eligibility, or ownership rules), the instrument does not offer an alternative shelter for the remainder. The instrument is silent about partial deposits and does not say whether a partial deposit secures non‑income treatment pro rata.

• Attribution and interposed entities. Paragraphs (cc) and (cd) address amounts attributable to forced disposals by an entity in which the person has a membership interest "either directly or through one or more interposed entities." Determining attribution through interposed entities can be legally and factually complex and requires applying tax law definitions and possibly tracing distributions or entitlements through corporate and trust arrangements. The instrument does not provide operational guidance on how attribution is to be established administratively.

• Causation and the "wholly or mainly" test. The definition of forced disposal requires the disposal to occur "wholly or mainly for one or more" of the enumerated reasons. That introduces a causation test. For example, a disposal may be partly voluntary and partly caused by drought or regulatory change, and the instrument leaves open fact‑based disputes about whether the disposal was "mainly" for the listed reasons. The instrument itself does not provide evidentiary standards or examples beyond a non‑exhaustive example in paragraph (a) (compulsory acquisition or change of law). Parties may face disputes with the department over whether a particular disposal satisfies the causal threshold.

• Welfare and veterinary decisions. The definition includes disposals motivated by "reasonable concern for the welfare of the livestock." That introduces a standard of reasonableness. The instrument does not define who assesses reasonableness, what evidence suffices, or whether a decision by a veterinarian, local authority or the owner will be decisive. The absence of standards could generate disputes.

• Interaction with tax administration and timing. The instrument requires deposit as an FMD under tax law to secure the non‑income treatment. Tax authorities may have procedures for when a deposit is accepted and for recording ownership that do not align perfectly with the 42‑day administrative window under the Social Security Act. The instrument does not explain how conflicts of timing between tax administration and the Secretary’s notification requirement are to be resolved.

• No internal enforcement detail. The Secretary is the recipient of notices, but the instrument does not require the Secretary to acknowledge receipt, provide a timeline for verification of deposits, or specify what documentary proof will be accepted. A claimant who notifies the Secretary but later cannot demonstrate deposit may lose the exclusion; procedural uncertainty is therefore a practical risk.

• Scope limited to Farm Household Support purposes. The instrument modifies the Social Security Act only for the purposes of Farm Household Support as set out in the Farm Household Support Act 2014 (s 4). The exclusion may not apply to other social security income tests or other benefits unless those regimes operate under the same provisions as applied by the FHSA 2014. Practitioners must not assume the non‑income treatment is general across all social security programs.

• No remedy for failed deposits. The instrument does not offer a remedial mechanism if a person has notified the Secretary but, for reasons beyond their control, cannot complete the FMD deposit within the 42‑day period (for example because of banking delays or tax authority processing time). The temporary protection ends when the 42 days expire, according to subsection 8(8AAAA).

• Evidence and recordkeeping burden. The person must be able to prove both receipt of the amount, the causal link to a forced disposal, the deposit into an FMD owned by them as defined in tax law, and any membership interest attribution. That creates a documentation burden; the instrument does not prescribe evidence but expects recipients to be able to satisfy administrative scrutiny.

These gotchas arise directly from the instrument’s text and its reliance on external definitions and tight timing. Practitioners should plan for documentation, early notification to the Secretary, and early engagement with tax advisers to ensure that FMD deposits are feasible and properly recorded within the 42‑day window.

Compliance requires a sequence of factual assessments, timely action and documentary proof. The following steps flow directly from the instrument’s text and indicate practical compliance priorities.

1. Determine whether the disposal is a "forced disposal of livestock". Apply the instrument’s definition found in Schedule 1, item 1. Confirm that the disposal (including killing or disposal of carcass parts) was carried out by an entity within the meaning of the Income Tax Assessment Act 1997 and that it occurred wholly or mainly for one or more of the enumerated reasons: (a) action by Commonwealth, State or Territory or authority that prevents commercial use of land or water, other than with free consent; (b) drought or natural disaster making reasonable support of the livestock impossible; (c) reasonable concern for welfare; or (d) a legal requirement to dispose (Schedule 1, item 1). Gather contemporaneous evidence to establish the causal link and, where relevant, the statutory or regulatory basis for the disposal.

2. Identify the recipient and ownership. Confirm who "received the amount" (natural person, trustee, company, partnership) and whether the recipient is an individual who can be the owner of a farm management deposit under the Income Tax Assessment Act 1997. If the receipt is for an entity, identify whether an individual holds a membership interest in that entity and whether the amount is attributable to the entity’s forced disposal (Schedule 1, item 2, paragraphs (cc) and (cd)).

3. Check farm management deposit eligibility and ownership under tax law. The non‑income treatment requires the amount to be deposited as a "farm management deposit owned by the person" within the meaning of the Income Tax Assessment Act 1997 (paragraphs 8(8)(ca) and (cc)). Before relying on the Social Security Act modification, confirm with tax advisers or the ATO that the amount can be deposited into an FMD in the recipient’s name, that ownership rules are satisfied, and that any caps or conditions under the ITAA 1997 will not prevent deposit of the relevant amount.

4. Act promptly on the 42‑day notification window. If a deposit cannot be made immediately, the recipient must inform the Secretary within 42 days after receiving the amount that they have received the amount and that it will be deposited as a farm management deposit owned by them (paragraphs 8(8)(cb) and (cd)). The notification must state the receipt (or a greater amount including it) and the intention to deposit. Ensure the notification is made in a form and to the office designated by the Secretary and retain proof of notification (date stamped correspondence, email with delivery receipt, or other verifiable proof). Remember subsection 8(8AAAA) ensures amounts meeting the notification conditions are not income at any time during that 42‑day period; the shielding effect terminates when the period ends if no deposit has been made.

5. Complete the deposit. Where possible, make the deposit into the farm management deposit within the 42 days. If the deposit is completed before notification, the amount falls under paragraphs (ca) or (cc) and is not income. Where notification was made pending deposit, complete the deposit as soon as practicable within the 42‑day period. Keep bank statements, deposit confirmation, and any tax authority correspondence verifying the deposit and ownership.

6. Maintain records evidencing causation and attribution. For disposals triggered by government action, compulsory acquisition notices, or changes to land or water use law, retain copies of relevant statutory instruments, acquisition notices, or correspondence. For drought or natural disaster, obtain relevant weather, agricultural extension, or authority statements. For welfare‑based disposals, obtain veterinary reports or other contemporaneous expert statements. For disposals compelled by law, retain the statutory requirement documents. For amounts attributable to an entity’s disposal, retain documents tracing entitlement and distribution to the person claiming the FMD deposit.

7. Liaise with advisers early. Because the instrument depends on tax law definitions, consult a tax adviser or the ATO in advance to confirm that the intended deposit will qualify as an FMD owned by the person and that any attribution through entities is correctly structured. Also consult a social security or administrative law adviser to confirm the form and content of the notification to the Secretary.

8. Anticipate administrative verification. Given the Secretary’s role in receiving notifications, expect requests for evidence. Provide documentation promptly and keep copies. If the department requires additional administrative forms, comply within specified timeframes to protect the non‑income treatment.

9. Consider partial deposits and split receipts. If tax law limits the size of FMD deposits or ownership rules prevent full deposit, plan how the portion deposited will be documented and how any balance will be treated for means testing. The instrument does not specify a procedure for partial deposit; therefore, document each step and flag the situation to the Secretary in the notification.

10. Monitor relevant departmental guidance. The instrument does not set out operational guidance on how notices should be delivered or what proof is acceptable. Administrative practice may evolve. Check departmental web pages, guidance notes, or contact points for any published instruction on how to give the Secretary the required notice and what evidence will be acceptable to secure non‑income treatment.

Following these steps keeps the recipient within the instrument’s textual requirements: establish that a disposal is a "forced disposal of livestock" (Schedule 1, item 1), ensure deposit or timely notification (paragraphs 8(8)(ca)-(cd)), and rely on subsection 8(8AAAA) where the notification conditions are met.
