sec.15 Asking for mediation

This section applies if— a mortgagee has given a farmer a notice inviting a request for mediation; or a farmer owes a farm business debt to a mortgagee, whether or not the farmer is in default, or at risk of default, under the farm mortgage. The farmer may give a request for mediation notice to the mortgagee. A request for mediation notice is a notice that— may, but need not, be in the approved form; and asks for mediation for the farm business debt; and states— if the farmer is not an individual—the name and contact details of the person authorised to act for the farmer in relation to the mediation; and Section 23 provides for when a party to a mediation may be represented at a mediation meeting by an agent with the mediator’s approval or, for a party that is a corporation, by an officer or employee. the farmer’s address for service of documents. The approved form for a request for mediation notice must provide for— the farmer to nominate 3 mediators from which the mortgagee may choose a mediator, to conduct the mediation, under section 18 ; and the farmer to request documents relating to the farm business debt and farm mortgage from the mortgagee under section 21 . s 15 amd 2020 No. 3 s 87 ; 2024 No. 17 s 192 s ch 1 pt 1 (sec.15-ssec.1) This section applies if— a mortgagee has given a farmer a notice inviting a request for mediation; or a farmer owes a farm business debt to a mortgagee, whether or not the farmer is in default, or at risk of default, under the farm mortgage.
