### 42 Transitional provisions
> Where a restraint order, an interim restraint order, a telephone interim restraint order or a registered external restraint order, all within the meaning of [Part XA of the](/view/html/inforce/2026-04-12/act-1959-077#HPXA@EN) [Justices Act 1959](/view/html/inforce/2026-04-12/act-1959-077) , has been made under that Part –

> > > (a) before the commencement of [section 35](#GS35@EN) ; and
> >
> > > (b) for the benefit of the spouse or partner of the person against whom the order was made –
>
> any contravention of that order that occurs after the commencement of this Part is to be dealt with as an offence under [section 35](#GS35@EN) .
