sec.27 Report about person’s criminal history or domestic violence history
To decide whether a person is disqualified from membership of the commission under section 19 (1) (a) (i) or (b) or section 20 (1) (a) (i) or (b), the Minister may ask the commissioner of police for— a written report about the person’s criminal history or domestic violence history; and if the request is about the person’s criminal history—a brief description of the circumstances of a conviction mentioned in the criminal history. The commissioner of police must comply with the request. However, the Minister may make a request under subsection (1) about a person who is not a commission member only if the person has given the Minister written consent for the request. The duty imposed on the commissioner of police to comply with the request applies only to information in the commissioner’s possession or to which the commissioner has access. If the Minister receives a report about a person under this section, the Minister must give a copy of the report to the person. The Minister must ensure a report given to the Minister under this section is destroyed as soon as practicable after it is no longer needed for the purpose for which it was requested.
