39Application of Division 5.2 (Act s 90XT, s 90YY)

#### 39 Application of Division 5.2 (Act s 90XT, s 90YY) For paragraphs 90XT(2)(a) and 90YY(2)(a) of the Act and paragraph 22(1)(b) of these Regulations, this Division sets out the method for determining an amount in relation to a superannuation interest of a member spouse at the relevant date if the interest: (a) is not a percentage‑only interest; and (b) is in the payment phase at the relevant date. > Note: This Division does not apply to a superannuation interest of a kind mentioned in subregulation 22(2).
