What it does
This Determination sets out, for the Military Superannuation and Benefits Scheme (MSBS), which items of information a trustee must supply and which it is not required to supply when information is requested under the Family Law (Superannuation) Regulations 2001. The instrument operates by reference to particular entries in the growth phase table (Part 4 of Schedule 1 to the Methods and Factors Approval) and the payment phase table (same location), and it distinguishes between (a) information the trustee is not required to provide under specified paragraphs of the Regulations and (b) information the trustee must provide (see ss 4-6).
Mechanically, the Determination:
- Defines key terms used in the text, including MSBS, officer and cross‑references to the Methods and Factors Approval, the Regulations and the Rules (s 3(1)).
- States that the Determination applies only to superannuation interests in the MSBS for which a method and factors have been approved under Part 4 of Schedule 1 to the Methods and Factors Approval (s 4).
- For growth phase interests it lists three items (corresponding to items 1-3 of the growth phase table) and, for each item, prescribes: (a) the particular information the trustee is not required to supply under paragraph 64(7)(a) of the Regulations; and (b) the particular information the trustee must supply under paragraph 64(7)(b) of the Regulations (s 5 and the table in s 5).
- For payment phase interests it sets analogous exclusions and positive obligations for two items (corresponding to items 1-2 of the payment phase table), applying to both ss 63(6B) and 64(7B) contexts in the Regulations (s 6 and the table in s 6).
The Determination therefore operates as a targeted modification to trustee disclosure duties under the Regulations for MSBS interests, narrowing the universe of mandatory outputs and substituting (in each listed case) a defined set of factor data and specified personal data about the member. It does not itself restate the content of the Regulations or Methods and Factors Approval beyond these cross‑references; it prescribes which Regulation paragraphs remain inapplicable to the trustee and which particular factor definitions and personal data the trustee must supply instead (see ss 5-6).
