#### 3.01 Fixing of hearing date (1) On the filing of an Application for Divorce, the Registry Manager must fix a date for the hearing of the application. (2) The date fixed must be: (a) for a joint application—at least 28 days after the application is filed; or (b) for any other application: (i) if the respondent is in Australia—at least 42 days after the application is filed; or (ii) if the respondent is outside Australia—at least 56 days after the application is filed. > Note 1: An Application for Divorce (other than a joint application) must be served on the respondent (see rule 7.03). > Note 2: When an Application for Divorce is served, the respondent must also be given a brochure approved by the Chief Executive Officer (see rule 2.03).
