17 Response to Form 8 application — Form 8A
(1) If a party (except an applicant) seeks an order (including an order for dismissal of the proceedings) in proceedings commenced by an application in accordance with Form 8, the party must file and serve a response in accordance with Form 8A.
(2) A party who files and serves a response in accordance with Form 8A may file and serve with the response an affidavit that is substantially in accordance with subrule (3) and Order 16.
(3) The deponent must set out, briefly and precisely, in the affidavit:
(a) in paragraph 1:
(i) that the deponent is the party on whose behalf the affidavit is filed; or
(ii) the deponent’s relationship to that party; and
(b) the evidence on which the court is asked to:
(i) make the orders (if any) sought by the deponent; or
(ii) dismiss the application.
