6Court or relevant Registrar may relieve from consequences of non‑compliance

#### 6 Court or relevant Registrar may relieve from consequences of non‑compliance (1) Subject to the Act and these Regulations: (a) the court or a relevant Registrar may, at any time, upon such terms as the court or relevant Registrar thinks fit, relieve a party from the consequences of non‑compliance with these Regulations, a rule of practice and procedure of the court applicable to the proceedings or an order made by a relevant Registrar; (b) the court may at any time, upon such terms as the court thinks fit, relieve a party from the consequences of non‑compliance with an order made by a court; and (c) the court may, upon such terms as the court thinks fit, dispense with the need for compliance by a party with any provision of these Regulations. (2) Where these Regulations fail to make provision on any matter, the court is empowered to give, and shall give, such directions as to practice and procedure as the court thinks fit. (3) In relation to proceedings that commenced before the commencement of these Regulations, a reference, in subregulation (1) or (2), to these Regulations shall be read as including a reference to the former Regulations in their application to those proceedings.
