#### 10A Proceedings for divorce order not to be instituted in a court of summary jurisdiction other than a prescribed court (Act s 44A) For section 44A of the Act, proceedings for a divorce order in relation to a marriage may not be instituted in, or transferred to, a court of summary jurisdiction other than the following prescribed courts: (a) a court constituted by a stipendiary magistrate who is the Principal Registrar, or a Registrar, of the Family Court of Western Australia; (b) the Magistrates Court constituted by section 4 of the Magistrates Court Act 1930 of the Australian Capital Territory; (c) the Court of Petty Sessions of Norfolk Island.
