What it does
This instrument is a proclamation made under sub-section 40 (3) of the Family Law Act 1975. Its operative effect is narrow and mechanical: it fixes a commencement date, 1 June 1976, and, from that date, makes it unlawful to institute in, or transfer to, the Supreme Courts of specified States and Territories certain classes of proceedings described in the Schedule. The proclamation states the date and the covered jurisdictions explicitly. It reads, in dispositive form, that the Governor‑General, “hereby- (a) fix 1 June 1976 as the date on and after which proceedings of the classes to which this Proclamation applies may not be instituted in or transferred to the Supreme Courts of the States of New South Wales, Victoria, Queensland, South Australia and Tasmania and of the Australian Capital Territory and Norfolk Island; and (b) declare that this Proclamation applies only to proceedings of the classes specified in the Schedule.”
Mechanically, there are three separate elements in the instrument: the statutory source of authority (s 40(3) of the Family Law Act 1975), the operative restriction (prohibition on institution and on transfer into the specified Supreme Courts), and the schedule that defines the classes of proceedings to which the prohibition applies by reference to the definition of “matrimonial cause” in sub‑section 4(1) of the Act. The Schedule lists which paragraphs (a)-(f) of that definition are included, and it specifies narrow exceptions preserving some matters already pending immediately before 1 June 1976.
The proclamation is executed by the Governor‑General acting with the advice of the Federal Executive Council and bears the formal signature line and sealing language: “GIVEN under my Hand and the Great Seal (L.S.) of Australia on 27 May 1976,” followed by the Attorney‑General’s command. There is no explanatory material within the proclamation itself setting out policy reasons, implementation modalities, or designated alternative fora. The instrument is therefore a formal jurisdictional direction with immediate legal effect on venue choices for the described classes of matrimonial proceedings from the fixed date.
